LIMITED SOURCE JUSTIFICATION

FOR FEDERAL SUPPLY SCHEDULE ORDER

1. Identification of the Agency and the Contracting Activity: This is a Limited Source Justification.

The Naval Medical Logistics Command (NMLC), acting on behalf of the Navy to meet the requirements of Naval Medical Center (NMC) San Diego (Branch Health Clinic Eastlake).

2. Nature and/or description of contract action being approved: The proposed action is conducted under the authority of the Multiple Award Schedule Program (Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, et seq.) and Title 40 U.S.C. 501, Services for Executive Agencies). This is a limited source action to be awarded as a new Federal Supply Schedule (FSS) order under V797P-4237B to ScriptPro USA, Inc. for one (1) robotic medication dispensing unit for the Branch Health Clinic (BHC) Eastlake. The placement of a Firm, Fixed-Price order is anticipated.

3. Description of the supplies or services required to meet the agency's needs (including the estimated value):

The proposed action is for one (1) robotic medication dispensing unit for BHC Eastlake. The equipment shall incorporate a workflow system using robotics for medication dispensing, manual prescription filling, prescription imaging, checking, filling and verification of all medications dispensed. The equipment shall be designed to prevent medication dispensing errors during prescription fulfillment and cross-contamination of products during dispensing.

Equipment shall be directed and controlled by a workflow management system (WFMS). The WFMS shall provide role-based security such that an operator’s tasks/access shall be limited to only the tasks/access they are authorized for. Solution shall utilize a method of scanning as a means of medication and patient verification throughout the dispensing process including the robotic medication dispensing, manual filling stations, PV stations and the issuing windows. The unit shall utilize the existing workstations at BHC Eastlake.

Equipment shall include a robotic medication dispensing unit that can automatically select a prescription vial of the proper size, fill the vial with the proper medication, and print and apply the correct prescription label directly to the filled vial. The prescription label shall include standard prescription information, a bar code, and USP auxiliary label information. Equipment shall use bar codes to confirm correct drug product and strength. Vials shall be filled directly from drug dispensing cells to prevent cross-contamination. The vial shall be collated for the pharmacist to perform a final verification.

Robotic medication dispensing unit shall have drug dispensing cells that can be cleaned and calibrated onsite by pharmacy technicians when changing the medication dispensed by the individual cells. Proposed units shall not require dispensing cells to be shipped offsite for cleaning and calibration prior to use with a new medication.

Proposed units shall allow for two separate vial sizes to be loaded into the system at once. Robotic medical dispensing unit shall be capable of dispensing C3-5 control drugs. Proposed unit shall have a method of locking to limit access and audit tracking of such dispensing cell.

The solution shall be able to connect and communicate with the installed ScriptPro telepharmacy network. The solution shall be able to interface and communicate with other pharmacy sites within the Navy telepharmacy network.

Equipment shall include servers/software licenses necessary to allow the system to operate as specified. Solution shall operate on Windows 7 operating system and comply with Navy Cybersecurity requirements. Vendor shall provide installation of equipment at site. The electrical requirement is 120 VAC, 60 Hz, and single phase.

Vendor shall be an Original Equipment Manufacturer (OEM) authorized dealer, authorized distributor or authorized reseller for the proposed equipment/system such that OEM warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions.

Upon delivery, the vendor shall be responsible for uncrating the unit/system and transporting it through the facility to the location of intended use for installation. If interim storage is required, the vendor shall make arrangements for the storage.

4. The Authority and Supporting Rational and, if applicable, a Demonstration of the Proposed Contract’s Unique Qualifications to Provide the Required Supply or Services: The statutory authority which permits restricting consideration of schedule contractors to fewer than that required in FAR 8.405-1 is 41 U.S.C. 251, as implemented by FAR 8.405-6(a)(1)(i)(B) - Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

ScriptPro USA, Inc. is the only vendor that can provide a system that is compatible with the currently installed ScriptPro telepharmacy system utilized on the Navy telepharmacy network and can communicate with other regional NMC San Diego clinics on the installed ScriptPro telepharmacy network. Due to limitations with staffing and the Composite Health Care System (CHCS) at the Eastlake clinic, the system will require direct telepharmacy communication with other clinics within the NMC San Diego network. ScriptPro USA, Inc. is the only vendor with the proprietary knowledge to properly integrate the system with the currently installed telepharmacy system; no other vendor can provide a system that is compatible with the installed base of ScriptPro equipment and can properly integrate the systems together. Only ScriptPro USA, Inc. can provide the necessary solution to meet the minimum requirements of the Government and is on the Federal Supply Schedule.

5. A Determination by the Ordering Activity Contracting Officer that the Order Represents the Best Value Consistent with 8.404(d): The General Services Administration (GSA) has determined the prices of equipment under the schedule contracts to be fair and reasonable for the purpose of establishing the schedule contract.

Therefore, ordering activities are responsible to make a separate determination of fair and reasonable pricing for individual orders. The Contracting Officer will determine, using the procedures in FAR 15.404-1, that the prices are fair and reasonable and will document such determination with a level of detail commensurate with the complexity and circumstances of each order within the contract file.

6. A Description of the Market Research Conducted Among Schedule Holders and the Results or a Statement of the Reason Market Research was not conducted: Market research was conducted in June 2016. It included a search of Federal Supply Schedules which identified no other vendor who can meet the minimum requirements of the Government. Other vendors were identified that can provide robotic medication dispensing systems: Innovation Associates, Parata and Amerisource Bergen; however, ScriptPro is the only vendor available that can provide a robotic medication dispensing unit compatible with the currently installed base of telepharmacy ScriptPro equipment on the Navy telepharmacy network.

7. Any other facts supporting the justification: This procurement uses a FSS and will be solicited and awarded in accordance with FAR Subpart 8.4.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: All future requirements will be handled on a case-by-case basis. As the barriers that preclude the agency from the requirements of section 8.405-1 are due to limited vendors on schedule, no actions can be taken by this agency to remove those barriers. If additional vendors are added to the FSS for this equipment, they will be considered as applicable
