Limited-Sources Justification (LSJ) FY25-067

This is a Limited-Sources Justification document for a follow-on task order under the GSA Multiple-Award Schedule Program. The Department of Homeland Security (DHS), Cybersecurity Infrastructure Security Agency (CISA), Chief of Contracting Office (COCO) proposes to award a sole-source bridge contract to incumbent contractor Lempugh, Inc. (located at 14409 Greenview Drive, Suite 200, Laurel, MD 20708) for Strategic Communication Support Services for CISA External Affairs. The original competitively awarded order (GS-07F-0086T-70RCSA21FR0000075) was issued on August 4, 2021, under GSA Schedule SIN 541910 (Marketing Research and Analysis). The bridge contract has a base period of six months and will provide communications, legislative analysis, Congressional engagement support, graphic design, video creation and editing, cybersecurity awareness campaign support, conference and event support, strategic engagement planning, digital media and photography support, media relations support, SharePoint maintenance, and writing and editing services.

The justification cites FAR 8.405-6(a)(1)(i)(C) as the authority for limiting sources to the incumbent contractor. CISA explains that the bridge contract is necessary due to unforeseen delays in the recompete acquisition process, initial funding insufficiency requiring scope redefinition, and a 45% loss in External Affairs federal staffing due to the Deferred Resignation Program. The recompete solicitation is targeted for release in October 2025 with award in November 2025. CISA intends to include FAR Clause 52.217-8 (Option to Extend Services) in the bridge order and will request additional discounts before placing the order. The anticipated order value exceeds $750,000 but does not exceed $15 million, requiring approval from the Procuring Activity Advocate for Competition or designee. The Contracting Officer intends to post this requirement on SAM.gov pursuant to FAR 8.405-6(a)(2)(i).

Limited-Sources Justification (LSJ)

For orders or BPAs exceeding the Simplified Acquisition Threshold

- 1 - LSJ No: FY25-067

LSJ No.: FY25-067

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.

4. Authority and supporting rationale.

The authority is FAR 8.405-6(a)(1)(i)(C) which specifies that, In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal

Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures. In order to ensure economy and efficiency, by mitigating operational risks and maintaining continuity of services, CISA/COCO proposes a sole-source bridge contract with the incumbent contractor, Lempugh, Inc. for a period of six months. The bridge contract will cover the period of redefined scope, allowing the project to continue while we finalize the revised deliverables and timeline within the new budget constraints for the pending recompete. The solicitation for the recompete is under review with a target release of October 2025. An award will be executed in November of 2025. CISA intends to include FAR Clause 52.217-8, Option to Extend Services in the bridge order.

Rationale:

This LSJ serves as the necessary documentation to support the Governments intent to award a follow-on task order that bridges the gap between incumbent order 70RCSA21FR0000075 and the pending recompete, this is due to unforeseen delays in the acquisition process. The initial project requirements were set based on an expected level of funding that, unfortunately, proved to be insufficient to cover the complete scope of work as originally planned. As a result, the project team had to pause and reassess the original requirements to ensure alignment with available financial resources. This led to the necessary redefinition of the projects scope in order to prioritize critical components and adjust deliverables in a manner that could be achieved within new budget constraints. The lack of sufficient funding required a thorough reevaluation of the project, which included identifying essential features that could be retained and non-essential elements that would need to be deferred or eliminated. This redefinition was a necessary step to avoid overspending and ensure that the project could be completed successfully within the new financial limitations.

The reassessment process involved significant collaboration among stakeholders and required additional reviews and approvals, further extending the project timeline. This delay was unavoidable, as it was critical to ensure the project was realigned in a way that is both financially responsible and sustainable. Additionally, External Affairs has experienced a 45% loss in federal staffing due to the Deferred Resignation Program. With less staffing EA is unable to meet their mission driving the need for contracted support staff. As Americas cyber defense agency and national coordinator for critical infrastructure security and resilience, CISA must rapidly communicate timely, clear and actionable information, mitigation guidance and alerts to a wide variety of stakeholders including federal

- 3 - LSJ No: FY25-067 departments and agencies, private sector partners, state, local, tribal and territorial governments, critical infrastructure owners and operators, Congress, and the public.

On August 4, 2021, DHS Office of Procurement Operations (OPO) competitively awarded a small business firm fixed price and labor hour order under GSA Schedule, SIN 541910, Marketing Research and Analysis vehicle. Under order GS-07F-0086T - 70RCSA21FR0000075, the contractor, Lempugh, Inc., 14409 Greenview Drive, Suite 200, Laurel, MD 20708. The Government therefore intends to award a follow-on order to Lempugh, Inc. in order to maintain continuity of operations while the recompete is being solicited and awarded.

5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).

GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable.

Therefore, ordering activities are not required to make a separate determination of fair and reasonable pricing, except for a price evaluation as required by 8.405-2(d). By placing an order against a schedule contract using the procedures in 8.405, the ordering activity has concluded that the order represents the best value (as defined in FAR 2.101) and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Governments needs. Additionally, CISA will request additional discounts before placing the order.

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

The recompete will be solicited via GSA Multiple Award Schedule (MAS) 541910, Marketing Research and Analysis Vehicle. Additional market research was not conducted for this action because the order will be made to the current vendor to bridge the gap between the current order and the recompete effort.

7. Any other facts supporting the limited-sources justification. Additional facts may be stated in this section. If there are no additional facts, you must state that here.

There are no other known facts supporting this justification.

8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made. Include a statement of actions taken or that will be taken to increase competition for future acquisitions of the same item/service (e.g., the government intends to revise overly restrictive technical specifications, acquire data rights, or pursue some other means to increase future competition).
