MICC Control No. 15-010
LIMITED SOURCE JUSTIFICATION
1. Agency/Contracting Activity: The Mission and Installation Contracting Command – Fort Bragg (MICC-FB)
2. Description of Action:
Nature: New Requirement Follow-on Order Mod to Existing Order Number
Order against: Federal Supply Schedule (FSS) Contract Number: W91QV1-14-F-0051; GSA
# GS35F5349H
Pricing: Firm-Fixed Price Time & Materials Cost Type
Funds: OMA Other Funds: OMAR
Name of Proposed Contractor: Advanced Resource Technologies, Inc. (ARTI) Street Address: 1555 King Street, Suite 400 City, State, Zip: Alexandria, VA 22314 Phone: (703) 682-4765
3. Description of Supplies or Services:
The estimated value of the proposed action is $474,116.88.
MICC-Fort Bragg (MICC-FB), as the ordering activity, is approving a follow-on order of task order W91QV1-14-F-0051, Local Area Network/Wide Area Network (LAN/WAN) Support Services.
This action is a task order generated from the General Services Administration (GSA) Federal Supply Schedule contract number GS35F5349H that was awarded to Advanced Resource Technologies, Inc. Services included Local Area Network (LAN), Wide Area Network (WAN), telecommunications, network security, graphics media, and logistics in support of Office of the Chief Army Reserve (OCAR) G6.
The original task order was awarded on a competitive basis in June 2014 for a six-month period using FAR Subpart 8.4 procedures. The 52.217-8 clause was not included in the original task order; therefore, the original task order service cannot be extended. This follow-on order will avoid duplication of costs that are not expected to be recovered through competition because this vehicle is a 3-month “stop-gap” award from 21 December 2014 through 20 March 2015 to prevent an imminent lapse in service and enables full and open competition to re-solicit these services. If this bridge contract is not approved, the Government will suffer unacceptable delays in acquiring these services and the interruption to the OCAR LAN/WAN will severely negatively impact OCAR’s critical mission capabilities.
The follow-on order will prevent a break in services allowing several ongoing crucial projects to continue while a follow-on competition is conducted by MICC-FB. The current task order ends on 20 December 2014. Fiscal year (FY) 2015 Operation and Maintenance Army Reserve (OMAR) funds will be utilized to fund the extension.
4. Authority:
ORDER AGAINST FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:
An urgent and compelling need exists, and following the procedures would result in unacceptable delays (FAR 8.405-6(a)(1)(i)(A));
Only one source is capable of providing the supplies or services required at the level or quality required because the supplies or services are unique or highly specialized (FAR 8.405-6(a)(1)(i)(B)); or
In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited sources procedures (FAR 8.405-6(a)(1)(i)(C));
In accordance with DFARS 208.405-70(b), mark the applicable exception:
A statute expressly authorizes/requires that purchase be made from a specified source [DFARS 208.405-70(b)(1)]
5. Rationale/explanation to support cited authority:
Three months of services are required in order to avoid a lapse in service, while the follow-on re-procurement contract is competitively solicited and awarded. Due to the short additional period of performance, only the incumbent contractor can provide the required services at an economical firm fixed price and without significant delay. The United States Army Reserve plays a critical role in defending our nation and it is vital that OCAR G6 North receives information technology services that provide technical excellence to support enterprise level IT requirements for the Chief, Army Reserve (CAR) and a support staff of approximately 350 users. OCAR is currently using information technologies such as high speed networking, client/server applications, global information dissemination and application programming and relies on the internet for information and dissemination and remote collaboration activities. It would be detrimental to the OCAR G6 to introduce another contractor to provide the same services, level of expertise and corporate knowledge existing in the contractor because the time needed to effectuate a seamless transition between contractors is not available nor is it economically feasible do so for a short term.
Impact: A lapse in service means that OCAR G6 would not have Local Area Network (LAN)/Wide Area Network (WAN), telecommunications, network security, graphics media, and logistics support services. All systems using LAN/WAN will cease to provide strategic command and control between both entities in the National Capitol Region and the functional commands throughout CONUS.
Alternatives: A list of alternatives include (1) using existing in-house IT Government personnel;
(2) using USARC G6 existing IT support services contract; and (3) submitting a World-wide Individual Augmentee System (WIAS) tasker to obtain Military Occupational Specialty 25-Series Enlisted personnel. The OCAR G6 has three Government personnel: Deputy (GS-15) and two Military Signal Corps Branch Chiefs. These personnel are supervisors and cannot provide these services for approximately 350 personnel. Adding OCAR G6 requirements to the existing USARC G6 contract would raise the cost substantially, exceeding 25 percent of the contract value and very likely being determined to be an out of scope modification (with its own legal impediments to rapid execution). Accordingly, this is not a viable option. The WIAS tasking process is a very bureaucratic and tedious process. It can take up to six (6) months to screen potential applicants and bring them on active duty. Thus, none of the remaining alternatives are viable options.
As the incumbent contractor, ARTI is currently providing acceptable performance. An award to a different contractor for this short period of time, either through competition or other method, could result in substantial duplication of costs to the Government which will not be recovered through competition since it is likely that a new contractor would face challenges in the assumption of ongoing projects which would degrade services currently being provided to the customer.
The revised milestones listed below outline the actions required to successfully award a competitive new LAN/WAN Support Services contract in support of OCAR G6. The phase-in period is expected to begin 20 February 15 and full performance will begin 20 March 2015.
17 Dec 14: RTOP provided to legal counsel for review 19 Dec 14: RTOP issued 16 Jan 15: Proposals received 19-23 Jan 15: Task Order Evaluation Board convenes 27 Jan 15: Initiate review of Business Clearance Memorandum (BCM) 30 Jan 15: Approval of BCM and task order award 20 Feb 15: Phase-in 30-day period begins 20 March 15: Full performance of task order
6. Market Research: Market Research was conducted for W91QV1-14-F-0051 and for this extension period. Preliminary market research included searching the FSS to estimate the cost of the work effort for the specified period of time based on the comparison of similar positions and skill levels necessary to accomplish the required mission. Preliminary market research has confirmed that these services are commercial and can be procured competitively for the follow-on.
7. Actions to Increase Competition: As explained above, there are numerous contractors that can potentially provide the requested services. Market research has shown that along with the FSS the Information Technology Services-Small Business (ITS-SB) contracts meets the Army’s enterprise infrastructure and infostructure goals with a full range of innovative, world-class IT support services and solutions at a reasonable price too. ITS-SB is a Multiple Award Indefinite Delivery/Indefinite Quantity (MA ID/IQ) contract vehicle. It is the Army’s source of Small Business Service contracts for IT-related services within Continental United States (CONUS). The contract vehicle has several capable contractors who can provide the requested services and it allows for a competitive follow-on award. MICC-FB is currently working a new requirements packet to award a follow-on requirement and offer fair opportunity to all contract holders under this contract vehicle.
