4. The authority and supporting rationale (see 8.405-6(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

FAR 8.405-6(b)(1) – Items particular to one manufacturer (brand name).

BFTA currently owns the perpetual software licenses for HPE Service Manager. This acquisition will provide software maintenance and support for the existing licenses.

The history of using HPE Service Manager began in 2004 when BFTA, using Commercial off the Shelf (COTS) HP software, built and implemented a shared automated tracking system, which refined and coordinated the way that trust beneficiary contacts are documented, tracked, and resolved.

The tracking system database has since become the system of record for documenting beneficiary contacts and documents an average of 260,000 beneficiary contacts annually. The trust beneficiary contract tracking system has been deployed to the BTFA Trust Beneficiary Call Center (TBCC) and at the 50 BTFA Field Operations Agency offices located on Indian reservations and in select urban centers across the country. In 2011, the Bureau of Indian Affairs (BIA) Social Services Offices began using the beneficiary contract tracking system to help manage supervised Individual Indian Monies accountholders. In 2013, the Department’s Land Buy Back Program began using the system to coordinate and facilitate replacement purchase offer packages and responses to Landowners.

Thus, the inclusion of a different brand of tracking system would require rebuilding a COTS application to meet BFTA’s business needs, including supporting BIA Social Services Offices as well as the Land Buy Back Program. BFTA estimates that to do so could cost up to $800,000, which makes continuing software maintenance and support to HPE Service Manager v.9.5x the Government’s most cost-effective solution.

Before any subsequent acquisition for a similar requirement is initiated in the future, market research will be conducted again to determine if there are alternatives to HPE Service Manager software maintenance and support. However, due to how cost-prohibitive it would be to implement new software, it is likely that BTFA will need to continue using HPE Service Manager for the foreseeable future.

9. The ordering activity contracting officer’s certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief.

10. Evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government’s minimum needs or requirements or other rationale for limited sources) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel.
