LETTERHEAD
DEPARTMENT OF THE NAVY
LIMITED SOURCE JUSTIFICATION
This acquisition is conducted under the authority of the Multiple Award Schedule Program as authorized by Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, et seq.) 40 U.S.C. 501, Services for Executive Agencies, as implemented at FAR 8.405-6(b)
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division
Aircraft Support Contracts Department, AIR-2.5
Exploration IV
22299 Exploration Drive Lexington Park, MD 20653 POC: Candice Anderson, AIR-2.5
2. Nature and/or Description of Action Being Approved.
JOINT STRIKE FIGTHER/VX23 has a requirement to outfit its facility. It is intended that a sole source award be made to the Kimball International to procure this work.
3. Description of the Supplies or Services Required to Meet the Agency’s Needs (including the estimated value).
JOINT STRIKE FIGTHER/VX23 requires office furniture to match the existing structure and components. This includes:
· Systems Workstations
· General Conference and Communication Areas
· Ergonomic Seating and Tools
· Secured Filing and Storage Units
The estimated cost of this procurement is $239,332.96.
4. Identification of the Justification Rationale (see 8.405-6(b)) and, if applicable, a Demonstration of the Proposed Contractor’s Unique Qualifications to Provide the Required Supply or Service.
Per (8.405-6)(b)(2), the item is peculiar to one manufacturer. A brand name item, whether available on or more schedule contracts, is an item peculiar to one manufacturer. Brand name specifications shall not be used unless the particular brand name, product, or feature is essential to the Government’s requirements.
In April 2011, the Fleet and Industrial Supply Center Norfolk (FISCN) awarded a group of Blanket Purchase Agreements (BPAs) to General Services Administration (GSA) Federal Supply Schedule contract holders and Kimball International. These BPAs were awarded within the GSA schedule in accordance with Federal Acquisition Regulations (FAR) subpart 8.405 against Federal Supply Schedule (FSS) contracts, the process for placing orders must be consistent with the procedures outlined by FAR Subpart 8.4 and Department of Defense FAR Supplement (DFARS) Subpart 208.4.
The BPAs allows Navy activities to streamline the solicitation and evaluation process, take advantage of increased savings from the GSA schedule rates and deeper volume discounts. This process also allows standardizing furniture requirements within the BPA method. The FAR allows justification in order to match existing furniture and may be used in conjunction with the BPAs.
NAVAIR formally standardize its furniture requirements in 2010 to meet the needs of Competency Aligned Organization Concept of Operations for the Naval Air Systems Command, Affiliated Program Executive Offices (PEOs and PMAs) and Fleet Readiness Centers (FRCs). In support of naval strategic direction and priorities, NAVAIR provides the infrastructure, social and financial framework for operations to successfully provide investments in furniture acquisition and related services to meet long-term needs. This strategy required market research and study of fiscal accountability, program requirements, cost cycle time, and technical authority.
Market study results conducted by this office and the Infrastructure Business Operation Department, Naval Air Warfare Center Aircraft Division, Code 7.10, concluded that Kimball International provided the best value for this project under FSC 7110(Office Furniture). The three required comparability factors studied included price, quality, and delivery time. Kimball International was comparable in these areas. Kimball International was more favorable in delivery time, installation management, and ease of procurement which decreases labor expenses throughout the procurement process.
Other company’s similar products do not meet, or cannot be modified to meet, the specific configurations of the Kimball International products. Kimball International products are 100% proprietary, only available to Government agencies, and has sole authority as to the future enhancement of these products. Kimball International furniture allows NAVAIR and its entities to maximize use of used furniture across the Command. Fabrics and finishes, systems furniture, case goods, workplace seating, etc., are being utilized as “NAVAIR Standards” to provide consistency, compatibility, and maximum use in reconfiguration, renovation, and reutilization.
NAVAIR’s reutilization efforts ensure a compatible, environmentally sound workspace for NAVAIR personnel. Standardization of NAVAIR furnishings eliminates the need to deposit unusable, incompatible products and related parts to local landfills, and supports environmentally friendly practices. Every 40 stations of remanufactured furniture NAVAIR reuses keeps one trailer load of furniture out of local landfills. The use of Kimball International products allows reuse and recycling of compatible cradle-to-cradle products.
NAVAIR fabrics and finishes are current and in production. Many local expansion and reconfiguration efforts are executed with excess or used material from previous efforts, saving hundreds of thousands of dollars per year over new material costs. New workstations will be fully integrated with existing workstations; therefore it is essential that the new networked office system components are fully compatible with existing components. Specifically new components must be attached to existing components (panels, enclosures, desks, integrated electrical and data connections, fabric and upholstery).
The rationale to procure on a sole-source basis is due to the need for structural interchangeability of pieces new and existing, and aesthetic compatibility with existing furniture. Because of the need for compatibility, Kimball International is considered the only brand-name item capable of meeting the Government’s requirements.
5. Determination by the Ordering Activity Contracting Officer that the Order Represents the Best Value Consistent with 8.404(d).
The contracting officer has determined that this purchase order represents the best value and results in the lowest overall cost alternative to meet the Navy’s needs. NAVAIR will seek additional discounts from the schedule holder if the price of the order exceeds the maximum order threshold, in accordance with FAR 8.405-1(d).
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
Market research was conducted by this office and the IBOD (NAWACAD 7.10). The joint conclusion is that no other manufacture is compatible with the existing Kimball International furniture. There is only one authorized reseller of Kimball International in the state of Maryland. With this in mind, the Government intends to issue a sole source BPA call to Jerrell Business Furniture Inc. via its local authorized reseller, Kimball International.
7. Any Other Facts Supporting The Justification.
Not applicable (N/A).
Kimball International is requested as the sole licensed provider of office furniture for this project. Jerrell Business Furniture is the only authorized distribution center of Kimball products for this geographical location.
8. A Statement Of The Actions, If Any, The Agency May Take To Remove Or Overcome Any Barriers That Preclude The Agency From Meeting The Requirements Of 8.405-1 And 8.405-2 Before Any Subsequent Acquisition For The Supplies Or Services Is Made.
At this time, JOINT STRIKE FIGTHER/VX23 has no plans for additional procurements. A discussion of subsequent acquisitions is therefore not applicable.
