8.405-6(a)(1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
This acquisition is being conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies, in accordance with FAR 8.405-6(a), Limiting Sources. An award will be made as only one source is capable of providing the services required at the level of quality required because the services are unique or highly specialized pursuant to FAR 8.405-6(a)(1)(i)(B).
The original award # HSHQDC-13-D-E2088 was competitively solicited and awarded to BAE under DHS Eagle II using the ordering procedures under FAR 16.505. The new order will be issued under BAE’s Multiple Award Schedule GS-00F-240CA. It is necessary to limit competition for new work described herein as only one source is capable of providing the services required at the level of quality required because the services are unique or highly specialized. These specific program and technical support services assist the Department of Homeland Security (DHS), Office of Chief Financial Officer (OCFO) in supporting its mission of being responsible for specialized programs associated with the identification, implementation, and management of a resource management solution (e.g., accounting, financial management, acquisition and grants management, asset management, and e-gov initiatives) for all DHS Directorates, Components, and Offices. These highly specialized services support currently expires on September 25, 2021. A bridge effort was not intended but due to unexpected delays in the acquisition process is required to provide transition services. BAE created the highly specialized applications that are currently being used to create the mandated financial reports for OCFO. Specifically, the Data Act monthly submission to the Department of Treasury and the monthly execution report submitted to Congress monthly. The processes required to generate these reports would be unknown to a new vendor and would require significant transition time exceeding the time frame required for each monthly report due date. The existing contractor is the only contractor that has the expertise and resources needed to seamlessly continue support without delays to RMT while the follow-on acquisition is put into place which is scheduled for
FY 2022 Q1.
5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).
The contracting officer has determined that issuing the proposed Task Order to BAE Systems Information Solutions for program and technical support services represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs. This order will be placed in accordance with FAR 8.404, “Use of Federal Supply Schedules.” The General Services Administration (GSA) has already negotiated fair and reasonable pricing rates. Discounts to these GSA schedule rates will be requested. Additionally, LSJ No: FY21-00242 Rev. 6.2021 2 -http://uscode.house.gov/
LSJ No: FY21-00242 Rev. 6.2021 - 3 -prior to issuance of the task order, the ordering activity will consider 2021 the level of effort and the- mix of labor proposed to perform the specific task being ordered in order to determine that the total price is reasonable. The contractor’s labor mix and level of effort will also be compared to the Independent Government Cost Estimate (IGCE).
6. No market research was conducted for this effort. However, extensive market research was conducted under the re-compete effort which will be issued competitively in F22 Q1. This will allow the Government to seek competition and eliminate barriers to competition.
7. Any other facts supporting the limited-sources justification. Additional facts may be stated in this section. If there are no additional facts, you must state that here.
There are no additional facts supporting this limited-sources justification.
8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made. Include a statement of actions taken or that will be taken to increase competition for future acquisitions of the same item/service (e.g., the government intends to revise overly restrictive technical specifications, acquire data rights, or pursue some other means to increase future competition).
The government intends to procure new program and technical support services for RMT in FY2022. This will allow the Government to seek competition in future acquisitions for the same type of support, thus eliminating the barriers to competition.
9. DHS intends to post this requirement on Fedbizopps pursuant to FAR 8.405-6(a)(2)(i).
10. Technical/Requirements Personnel Certification.
Pursuant to FAR 8.405-6(c)(2)(x), I certify that this requirement meets the Government’s minimum need and that the supporting data, which form a basis for the Limited-Sources Justification, are accurate and complete.
