OPOAM 3008.405-6(a)(2) Limited-Sources Justification (LSJ)
For orders or BPAs exceeding the Simplified Acquisition Threshold
WC-MCMS PAGE 1 OF 4
LSJ No: FY20-0085
LSJ No.: FY20-0085
This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.
1. The Department of Homeland Security (DHS), Office of Procurement Operations (OPO), Departmental Operations Acquisition Division (DOAD) proposes to award a DHS-wide single award Blanket Purchase Agreement (BPA) pursuant to FAR 8.405-6, Limiting Sources. This BPA will be established against a General Services Administration (GSA) Federal Supply Schedule (FSS) utilizing the procedures outlined in FAR Subpart 8.405.
2. DHS/OPO intends to limit the number of sources solicited pursuant to FAR Part 8.405-6(a) for the procurement of DHS-wide worker’s compensation (WC) medical case management services (MCMS) support for the Office of the Human Capital Officer (OCHCO). The proposed contractor is:
Managed Care Advisors, Inc.
7700 Old Georgetown Road, Suite 750 Bethesda, MD 20814 GSA FSS No.: GS-02F-0128W
3. This requirement is to obtain continued Enterprise-Wide support for the DHS WC MCMS program and assure timely and successful return of DHS employees to the workforce. The WC-MCMS encompasses: (1) Injury Care Support Services; (2) Medical Case Management Services; and (3) an Information Technology (IT) Solution (Services and capabilities) that encompasses an existing (operational) Case and Reporting Management Information System (MIS).The period of performance is a six (6) month base followed by a six (6) month option period at a total estimated cost of .

4. This acquisition is being conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies, in accordance with FAR 8.405-6(a), Limiting Sources. In accordance with 8.405-6(a)(1)(i)(A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays.
In September 2013, DHS OPO established a DHS-wide Blanket Purchase Agreement (BPA) GS-02F-0128W/HSHQDC-13-A-00048 with Managed Care Advisors, Inc. using the competitive ordering procedures at FAR 8.405 for services in support of WC-MCMS. The BPA expired 03/26/2019 with task orders eligible to extend up to one year beyond the expiration of the BPA.

In October 2019, DHS OPO released a solicitation, 70RDAD20Q00000002, using the competitive ordering procedures at FAR 8.405 to establish a new DHS-wide BPA for WC- MCMS. Receipt of quotes for 70RDAD20Q00000002 also closed in October 2019.
Quotations were received. However, the evaluation of quotes received has taken longer than anticipated due to unforeseen scheduling delays and resulting in a potential lapse in services.
The WC-MCMS Services are required throughout the United States in all 50 States, the District of Columbia, and U.S. Territories including Puerto Rico, U.S. Virgin Islands, Guam, Northern Mariana Islands and American Samoa. WC-MCMS provides an Integrated MCMS Solution encompassing: (1) Injury Care Support Services; (2) Medical Case Management Services; and (3) an Information Technology (IT) Solution (Services and capabilities) that encompasses an existing (operational) Case and Reporting Management Information System (MIS). WC-MCMS support provides centralized processes, procedures, and IT services that would ensure successful processing of WC claims, timely and successful return of DHS employees to the workforce. Should the Government fail to have a DHS-wide vehicle in place, there will be unacceptable delays in fulfilling the agency’s requirements. While the original BPA expired in March of 2019, each of the Components were able to issue task orders against that BPA which could extend up to one year beyond the expiration of that BPA. Those Task Orders are now expiring at the end of March 2020. However, it is essential that services continue for HQ and each of the Components until the new BPA can be awarded. The country is currently experiencing a medical pandemic and the President has declared a national emergency (https://www.whitehouse.gov/presidential-actions/proclamation-declaring-national-emergency-concerning-novel-coronavirus-disease-covid-19-outbreak/). One of the services provided by the WC-MCMS is to provide reporting and assistance to those experiencing medical issues such as the current pandemic, the COVID-19. Awarding a short term DHS-wide BPA will allow the Components to continue to leverage economies of scale in procuring these services as well as allow for any transition services that may be needed. It will also ensure that DHS can continue services in the event of a protest once the long term BPA has been awarded.
5. The Contracting Officer has determined that issuing the proposed DHS-wide single award BPA to Managed Care Advisors, Inc. for WC-MCMS represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs. This BPA will be placed in accordance with FAR 8.404 “Use of Federal Supply Schedules”, and will be issued against Managed Care Advisors, Inc.’s GSA FSS GS-02F-0128W. The Contracting Officer has also verified the required services are on Managed Care Advisors, Inc.’s GSA FSS GS-02F-0128W. GSA has already negotiated fair and reasonable pricing rates, however; the Contracting Officer will make a separate determination of fair and reasonable pricing for this BPA. Additionally, the Contracting Officer will seek a discount from the Schedule prices.
6. Market research was conducted prior to issuing 70RDAD20Q00000002, resulting in the use of competitive ordering procedures at FAR 8.405. The most suitable acquisition vehicle is GSA FSS 738 X, however; the incumbent is the only vendor currently capable of providing

personnel with the required skillset and an approved IT solution to maintain services without an interruption. To award to another vendor without sufficient transition would cause a disruption of services and place the mission at a high risk of failure. As such, any vendor other than the incumbent would be incapable of fulfilling the required services absent a significant and detrimental delay.
7. There are no additional facts regarding this limited-sources justification.
8. DHS OPO is currently in the evaluation phase of a competitive procurement for these services and intends to award by the end of third quarter of this fiscal year, thus eliminating the barriers to competition. The current long term BPA was competed, and DHS did receive more than one response to that solicitation.
9. DHS intends to post this requirement on Fedbizopps pursuant to FAR 8.405-6(a)(2)(i).
