LSJ No.: FY14-0460

Limited-Sources Justification

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.

1. Agency and Contracting Activity.

The Department of Homeland Security (DHS), Office of Procurement Operations (OPO), National Protection and Programs Acquisition Division (NPPAD), proposes to increase the ceiling of Contract Line Item Number (CLIN) 3004, Surge, of Task Order No. GS- 10F-0186U/HSHQDC-12-F-00087 using limited competition procedures pursuant to Federal Acquisition Regulation (FAR) 8.405-6(a) Limited Sources.

2. Nature and/or description of the action being approved.

DHS has a requirement to increase the ceiling of CLINs 3004 of Task Order No. GS-10F- 0186U/HSHQDC-12-F-00087 on a limited-sources basis to meet the increased need of the Office of Cybersecurity & Communications (CS&C) for acquisition support services.

CLIN Description Estimated Value 3004 Surge $2,472,272.00

Total $2,472,272.00

4. Authority and supporting rationale.

This acquisition is being conducted under the authority of the Multiple Award Schedule Program in accordance with FAR 8.405-6(a), “Limited Sources”. In accordance with FAR 8.405-6(a)(1)(i)(C), this ceiling increase is being conducted on a sole-source basis, in the interest of economy and efficiency as a logical follow-on to an original Federal Supply Schedule order No. GS-10F-0186U/HSHQDC-12-F-00087.

It is necessary to limit competition for additional work described herein as a logical follow-on for the reasons listed below:

This is a logical follow-on on to an original Federal Supply Schedule order No. GS-10F- 0186U/HSHQDC-12-F-00087 already issued under the contract, and all awardees were given a fair opportunity to be considered for the current task order.

The relationship between the current task order and the follow-on is logical because the scope of the work required for the extension remains the same.

This increase is necessary to provide sufficient level of support to CS&C, Office of Chief Technology Officer (CTO), with the development of the Weather Map Project, and the Budget, Finance and Acquisition (BFA) team with Database support and Contracts Management. The surge support will also assist the CTO team with the requirements development process, which will include documents to outline detailed processes and procedures for CS&C integrated requirements management system. Additionally the surge support will assist with the development of an acquisition plan for the strategic integration of CS&C acquisition activities supporting the Weather Map Project. CS&C has amassed a considerable number of contracts that have remained open well past the end of the contract period of performance (PoP) in addition to a substantial number of the unexpended obligations that required de-obligation and close out. This surge will help CS&C clear this backlog, and develop the appropriate processes and procedures, during this period, that will allay concerns regarding future closeout backlogs.

This contract is on the last option year of the contract and it is beneficial to the Government to increase the level of effort to meet the mission of CS&C which includes UDO obligation programs, contract closeout, Weather Map Project and Database support.

Integrity Management Consulting Inc. as the incumbent possesses the immediate capacity and understanding of the requirement. Although other firms with the potential to support this requirement exist, these companies could not perform this requirement without significant preparatory activities and transition assistance from the incumbent contractor in order to perform at the level required. The time and expense associated with a new contractor would be cost prohibitive and could potentially jeopardize the additional support required by CS&C. Also, it would be difficult to get a new contractor’s personnel cleared in a timely manner. Getting cleared personnel for a new contractor, especially if they do not currently hold the required facility and personnel security clearances, DHS suitability can take 2-3 months, or longer.

5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).

The contracting office has determined that issuing the proposed modification of the Task Order HSHQDC-12-F-00087 to Integrity Management Consulting Inc. discussed earlier herein, represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs. The proposed discounted labor rates will be reviewed and analyzed in comparison with both the current labor rates of the task order and other comparable General Services Administration (GSA) schedules.

The Contracting Office (CO) will evaluate the level of effort and the mix of labor proposed to perform the specific task being ordered in order to determine that the total price is reasonable. Additionally, the CO will evaluate the proposed prices by comparing them to the Independent Government Cost Estimates (IGCE).

The CO has determined that the anticipated prices will be fair and reasonable based upon the GSA schedule labor rates which have already been determined to be fair and reasonable.

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

Market research was conducted and it indicated that other GSA Schedule holders could perform the services. However, none of the vendors would be able to immediately meet the requirement within the given time at the level required.

7. Any other facts supporting the justification.

There are no additional facts supporting this justification.

8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made.
