NGB Control No: 20-0013 Contractor: Price Modern, LLC.
Supply/Service: Haworth Furniture Materials and Ancillary Services
Advocate for Competition:
Supply/Service: Haworth Furniture Materials
Department of the Army FAR 8.405-6 Limited Sources Justification Under the General Services Administration
Federal Supply Schedule Program
1. Contracting Activity: National Guard Bureau Operational Contracting (W9133L) 111 S. George Mason Drive Arlington, VA 22204-3273\
2. Description of Action: The National Guard Bureau requests a Firm-Fixed-Price (FFP) Blanket Purchase under the General Services Administration (GSA) Federal Supply Schedule (FSS) Program with Price Modern, LLC, 4400 Forbes Blvd, Suite A.
Lanham, MD 20706. The Government will execute this action against FSS contract GS- 28F-0031R. Projected award is September 2020 and fiscal year 2020 Operations and Maintenance funds will be used. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
3. Description of Supplies/Services: The National Guard Bureau locations utilize Haworth Furniture Systems throughout all work spaces as well as common areas. The separate NGB facilities have an ongoing need to reconfigure office layouts and workstations based upon fluctuations in workforce structure. This reconfiguration of work space and placement/replacement of furniture requires a contractor who is authorized to provide Haworth furniture as well as obtain parts and pieces to match the existing Haworth systems furniture. This requirement is primarily a supply buy with ancillary design services, installation services, warehousing, and inventory control and delivery services. Systems furniture, including monolithic, frame and tile, is a generic term for panels, work-surfaces, shelves, and other items sold by a single manufacturer as a package for furnishing offices. Cubicles are the items most often associated with system furniture, but other open plan arrangements such as office landscapes are included.
Period of Performance: September 2020 to September 2025 Total Value: $9,108,104.00
4. Authority Cited: Title III of the Federal Property and Administrative Services Act of 1949 (41U.S.C. 251, et. Seq) and Title 40 U.S.C 501, Services for Executive Agencies, as implemented by FAR 8.405-6 and substantiated by the following:
FAR 8.405-6(a)(1)(i)(B). Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
5. Reason for Authority Cited:
a) The particular Haworth brand name is essential to the Government’s furniture requirement and market research indicates other companies similar products do not meet Agency needs and cannot be modified to meet Agency needs. As the Haworth
Supply/Service: Haworth Furniture Materials brand furniture and office systems are the sole systems utilized within the NGB locations, the only products that can meet agency needs are Haworth products. Supporting this assessment are the below areas.
1) Functional Compatibility with Existing Furniture. From a functional perspective, only Haworth brand products are fully compatible with the Government existing Haworth furniture. Specifically, Haworth furniture systems consist of multiple interlocking parts that are only compatible with other Haworth furniture. The Government is not able to accept equivalent parts/systems as they are not compatible with all existing furniture within the NGB facilities.
2) Design Compatibility with Existing Furniture. Similarly, the Government’s market research indicates that only Haworth brand products are compatible with the Government’s existing Haworth furniture from a design and appearance perspective.
Specifically, only Haworth furniture systems have matching panels, desktops, windows and other components that are visually consistent with existing furniture. Utilizing other brands would result in a patchwork of different furniture that is not consistent, physically compatible or aesthetically appealing.
3) Impacts of Managing Multiple Furniture Inventories. Ancillary to the above reasons, the Government has an inventory of existing Haworth furniture stock that will be utilized on future projects. The Government-owned Haworth components currently in stock are worth approximately $500,000.00 and their repurposing under this IDIQ results in savings to the Government. To manage multiple furniture systems would introduce unnecessary logistics and cost burdens associated with multiple furniture systems. For instance, with multiple brands, the Government would have to procure multiple sets of desktops, connectors, conduit, lower panel, glass panels, drawer sets, etc. Any savings received through competition that introduces a new brand would likely be offset by the additional costs associated with maintaining multiple inventories.
b) The only viable alternative to utilizing the single source as outlined under paragraph 4.0 is a competitive award to a vendor whose utilizes furniture other than the Haworth brand materials. This alternative would result in the Government inability to reconfigure existing furniture areas as other vendor furniture materials would not be compatible with existing furniture systems. The existing stock of furniture materials that is utilized for reconfiguration would not be usable with the new vendor brand and the Government would be unable to sway in/out individual pieces at the Government facilities.
c) Other considerations
1) There is no existing Government vehicle to obtain the required Haworth furniture materials and the ancillary services to install and maintain those furniture materials placed at the National Guard Bureau Facilities. The ordering period reflects the on-going nature of the furniture materials and ancillary services required to meet the changes in organizational needs, manning, as well as growth at the National Guard Bureau facilities.

7. Market Research: The Government has utilized various methods to obtain additional sources, if available, to propose on this requirement. The Government posted a sources sought on December 28, 2018 to determine if additional sources were capable of proposing for this Haworth-specific furniture requirement. While numerous vendors submitted inquiries or information indicating they could perform the requirement, none were able to describe how they would ensure seamless blending of their furniture solution and the existing Haworth furniture systems. Unlike freestanding furniture pieces like bookshelves and filing cabinets, the office furniture systems are held together by OEM-specific locking mechanisms and assembly pieces which are not interchangeable with other systems.
The Government also posted a synopsis for a Haworth Furniture IDIQ in February 2019 followed by a sole source justification in November 2019.
8. Other Facts:
a) Procurement History: The awards prior to this proposed BPA acquisition were project-specific and of a limited duration. There are no previous or current contracts that cover the full range of NGB furniture supply and ancillary services needs
. Historical awards for furniture are outlined below.
