LIMITED SOURCES JUSTIFICATION FOR FEDERAL SUPPLY SCHEDULE PROGRAM

Task Order Number: GS-00F-008DA Task Order 15PCFD23F00000001

Upon the basis of the following justification, I, ___________________ , as Contracting Officer, hereby approve the use of sources limited to fewer than those required in FAR 8.405-1, FAR 8.405-2, and FAR 8.405-3 pursuant to the authority of 41 U.S.C. 251 as implemented by FAR 8.405-6(a)(1)(i)(C). This acquisition is conducted under the authority of the Multiple-Award Schedule Program (FAR 8.401).

(1) Agency and Contracting Activity

The contracting activity is the US Department of Justice (DOJ), Office of Justice Programs (OJP), Office of Administration (OA), Acquisition Management Division (AMD), located at 810 7th Street, NW, Washington, DC 20531.

The requiring activity is US Department of Justice (DOJ), Office of Justice Programs (OJP), Office of Chief Financial Officer (OCFO).

(2) Nature and/or description of the action being approved

The OJP OCFO Strategic Planning and Performance Division (SPPD) requires the continuation of technical assistance to support OJP’s Performance Management (PM) structure and in providing OJP leadership and staff with access to timely, relevant, and valid performance data, data analytics and visual mapping that will be used for developing and managing programs, policy and leadership decision-making; strategic planning; and, stakeholder communications.

OJP is committed to maximizing the effectiveness and efficiency of its programs and operations, linking program performance measures with OJP and Departmental strategic goals and resources, and aligning its PM structure with the Government Performance and Results Act – Modernization Act of 2010 (GPRA-MA). The PM structure integrates high-quality data, analysis, and evidence into policy decisions, budget requests, strategic planning, performance reporting, and grant monitoring. OJP uses the PM structure to ensure accountability for results and showcase its wide-ranging programs and accomplishments to all of its stakeholders. The PM structure is designed to streamline data management across OJP’s bureaus and offices, including data collection, validation, verification, analysis, and reporting.

To facilitate this process, OJP is seeking expertise and support in developing and reporting performance data and conducting data analytics and strategic planning activities. The PM structure will continue to expand and may change as DOJ’s grant making entities adopt and use Department-wide shared grant services.

In support of this effort, the Contractor shall provide technical assistance in a range of PM activities, including developing, revising, and reporting performance data, cataloging OJP performance measures and aligning them with relevant survey questions, and conducting data analytics and strategic planning activities. OJP seeks support in developing its four-year strategic plan, which will include performance measures to measure success. Support is also needed to document policies and procedures to support the performance management structure and communicate via SharePoint, MS Teams, and other platforms.

OJP proposes to enter into a single-award GSA Schedule task order on a basis other than full and open competition to the following Vendor:

Booz Allen Hamilton, Inc.

8283 Greensboro Drive McLean, VA 22102

(703) 902-5000

This task order will commence on March 27, 2023 in a three (3) month base period ending June 26, 2023 with a total task order ceiling of $189,587.52.

(3) A complete description of the Supplies/Services required to meet the Agency’s needs

This is a requirement to obtain the continuation of services of Booz Allen in its current capacity providing performance measurement services. Booz Allen shall provide the continued services and support to OCFO in fulfilling its performance measures, research, and evaluation responsibilities accomplishing the following tasks: 1) Performance data measures analysis; 2) SharePoint development; 3) Performance management processes; and 4) Strategic planning.

(4) An identification of the LSJ rationale

The statutory authority permitting other than full and open competition is 10 USC 2304(c)(1) implemented by the Federal Acquisition Regulation (FAR) is Subpart 8.405-6(a)(1)(i)(C) entitled "In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures".

(5) A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d)

The Contracting Officer determines that the Contractor's price is fair and reasonable based on comparison to market rates and historical rates paid on past services. Furthermore, the Contracting Officer evaluated the Contractor's rates against the market in the one (1) single subsequent awarded 3-month option period as well as comparable labor rates.

(6) Description of the market research conducted among schedule holders, and the results of the research, or a statement why market research was not conducted. A statement must be made that the supplies and services are available from the FSS

The Government utilized internet and GSA schedules, as well as interactions with other US Department of Justice entities to identify capable vendors who could provide this service. The Government released an RFI (Request for Information) on GSA EBuy on March 1, 2022 to identify potential vendors in market research. After the evaluation of the RFI responses, a formal RFQ (Request for Quote) was posted on GSA EBuy on June 17, 2022. The evaluation of RFQ responses is under an extended evaluation period, and at the current time an award will not be made prior to end of this service. Because of a pressing need for this service, the Government is issuing a direct sole source award to the Vendor.

This requirement is suited to a logical follow-on in accordance with FAR 8.405-6(a)(1)(i)(C) as awarding to another source is likely to result in the disruption of the development of the Department’s response to a critical, emergent need for support for OCFO's Performance Measurement Tool (PMT) and data analysis.

Awarding to a Contractor other than Booz Allen could result in substantial duplication of effort and costs to the Government and would cause unacceptable delays. These costs would not expected to be recovered through competition. The Government has chosen to minimize its risk for the successful completion of the requirement by determining a logical follow-on would be in the best interest of the Government.

(7) Any Other Facts Supporting the limited sources justification

There are no additional facts to be reported in this section.

(8) A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made

OCFO continually re-evaluates its metrics and performance measures to determine which information is required to best allow it to adapt to change and achieve its mission. No new tasks are being identified and provided for in this task order.

An existing competitive solicitation is set to be awarded in the 2nd or 3rd quarter of calendar year 2023.

(9) The ordering activity Contracting Officer’s certification that the justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief and evidence that the supporting data that form a basis for the justification have been certified as complete and accurate by technical/program personnel
