The SEC is required by the EEOC to have effective and timely complaint processing programs with verifiable and comprehensive case tracking systems that have the capability to populate EEOC's web-based Form 462, the Annual Federal Employment Opportunity Statistical Report of Discrimination Complaints. It requires agencies to develop internal time frames for each step of the complaint process and regularly monitor them for compliance.

Currently, the EEOC utilizes the iComplaints System as their primary system, along with 90% of the federal government for the collection and statistical processing of EEO information to and from federal agencies. iComplaints was developed specifically to manage the EEO process and generate the Form 462 annual report, iComplaints includes a number of critical features required by government agencies and departments for tracking and managing EEO complaints and cases. Its robust set of business rules ensures compliance with EEOC MD-110, EEOC reporting requirements and 29 CFR 1614. All of these capabilities are provided through a highly automated interface that provides exceptional 'point and click' ease of use while minimizing maintenance needs.
Along with the exclusive reporting capability to the EEOC, the I-complaints system also collects data for the No Fear Act as required by federal law. The iComplaints QRM module introduces quality report reviews and assessments for the 462 Report. Specifically, this software runs a Checklist Report to determine which sections of the Report would pass or fail if submitted to the Government. It reports the variance information down to the individual complaint.
The iComplaints System is the only known system that can satisfy the reporting required by law and to the degree required by the EEOC.
If the product/services are not procured, the SEC would not be able to track the SEC’s EEO complaints and report to the EEOC in a timely manner.

Market Research was conducted by searching the web and Government sites such as GSA Advantage. While OEEO was able to find systems similar to Entellitrak that can track EEO complaints, there were no systems found that collected and tracked information in the format required by the EEOC. Nor was there any system that could populate the information into 462 Report format and upload directly to the EEOC portal. To utilize another system, additional formatting and IT interfacing would have to occur in order to upload to the EEOC’s webpage.
