2. Nature of the Action:

We seek approval of a Limited Sources Justification (LSJ) to obtain further installation services for FM Systems software that the agency purchased and had installed by DLT Solutions in fiscal year 2014. Along with these services, DAES requires maintenance of currently owned AutoCAD and Revit (Autodesk) design software. The Office of Acquisition and Grants will solicit a quote from and award a single firm-fixed price Task Order for a 12-month period of performance with three year options.

The required services are for continued installation and setup of FM Systems software. In fiscal year 2014, the agency purchased FM Systems software from DLT, task order SS00-14-31682, along with the services to install the software and connect the FM Systems database with the existing agency AutoCAD graphic database. Since the 2014 task order was issued, the agency has expanded to Autodesk (AutoCAD & Revit design software) for its building models. The additional required services will further the implementation of the FM Systems software by connecting the FM Systems software database to the Autodesk Revit graphic database to facilitate the agency’s Facilities Management Team in space planning. These additional services will allow ORM to expedite the expansion from AutoCAD 2D data to Revit 3D design.

As the implementation and connection of these databases is furthered ORM will also require a maintenance subscription for the Autodesk software.

ORM uses Autodesk design software for the design and maintenance of agency facilities. Autodesk is used by nationwide facilities teams for drafting, engineering analysis, and design in 2D and 3D formats, and to create design intent drawings of SSA facilities prior to construction. This assists the agency in maintaining compatibility with GSA and outside industry/contractors using the same software.

The maintenance subscription for Autodesk software is based on the level of support purchased. Each level of support offers assistance with installation and configuration as well as troubleshooting issues with the software. ORM requires advanced support. Advanced support provides access to a package of Autodesk online support services including but not limited to unlimited, priority, one-on-one Autodesk web support, as well as extended hours and global phone support from senior Autodesk support specialists, remote desktop assistance, and prioritized web support options.

The maintenance subscription for Autodesk, Inc. software includes updates, fixes and patches, as well as online and telephone technical support, allowing the software to remain operational in a changing environment. This maintenance will allow ORM access to the latest changes and security patches, and allows the software to continue to operate in a changing environment.

4. Authority and Justification Rational

Authority: FAR 8.405-6(a)(1)(i)(B) – Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

ORM has determined that it would be harmful to ongoing projects and detrimental to the compatibility with GSA and outside industry contractors who use the same software, to change the incumbent service and software maintenance provider. The current contractor, DLT, has completed a comprehensive requirements development phase with the agency, security and suitability, and has an intimate knowledge of agency policy and systems architecture, as well as the software and its installation in SSA’s environment. In order to maintain the level of quality associated with the highly specialized services already delivered during the installation phase, DLT, is considered, to be the only source for this requirement.

Along with the aforementioned rational, AutoCAD does not sell directly to the government, but solicits its products through authorized resellers. DLT is the only authorized reseller who sells direct to the Government through their General Services Administration contract, GS-35F-267DA.

5. Determination of Best Value

As provided in FAR 8.404(d), General Services Administration (GSA) has already determined the prices offered for supplies and fixed-price services and rates for services offered at hourly rates, under schedule contracts, to be fair and reasonable. By placing an order against a schedule contract using the procedures in FAR 8.405, the contracting officer (CO) has concluded that the order represents the best value and results in the lowest overall cost alternative to meet the Government’s needs. In addition, the CO will seek a price reduction for prices offered by the contractor consistent with FAR 8.405-4.

6. Market Research Conducted

Market Research determined that only DLT can provide the required services through GSA. CADD Microsystems is the manufacturer representative of the FM Systems software. They informed SSA that the only contractor with a GSA schedule who can perform these specific services is DLT Solutions.

A review of the prior orders provided the following market research:

1) Task order, SS00-14-31682, was awarded against DLT’s General Services Administration contract #GS-35F-4543G. The task order was not competed; it was awarded with an approved LSJ to restrict competition under the authority of FAR 8.405-6(b), Items peculiar to one manufacturer.

2) Task order SS00-16-30718, it was awarded with an approved LSJ under authority of FAR .405-6(a)(1)(i)(B), Only one source.

3) Task order 28321317FDX030104, was also not competed; it was awarded with an approved LSJ under authority of FAR 8.405-6(a)(1)(i)(B), Only one source.

4) Task order 28321318FDX030507, was also not competed; it was awarded with an approved LSJ under authority of FAR 8.405-6(a)(1)(i)(B), Only one source.

7. Removing or Overcoming Barriers

We will continue to survey the marketplace by synopsizing our requirements and reviewing product literature and capability statements the vendor community submits.
