About this file
This document is a Justification and Approval (J&A) for a sole-source award to Feith Systems and Software, Inc. under a General Services Administration (GSA) Multiple Award Schedule (MAS) contract. The J&A states that the Department of Labor (DOL) requires continued professional services and software maintenance for the Feith BridgeLogIQ electronic records management platform, which was previously implemented through a competitive contract. Feith is the sole developer and certified service provider for the BridgeLogIQ platform, and switching to another system would result in unacceptable delays and significant additional costs for DOL. The J&A also notes that the prior contractor, AASA Inc., can no longer provide the required FEITH BridgeLogIQ software maintenance or support services. The sole-source award to Feith will allow DOL to continue implementation and integration of the BridgeLogIQ software, connect new record source locations, and implement new features and functions to the existing records management platform.

4. IDENTIFICATION OF THE AUTHORITY AND RATIONALE
This acquisition is conducted under the regulatory authority of FAR 8.405-6(a)(1)(B), only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
During the initial implementation phase of the DOL electronic records management system capabilities, DOL analyzed multiple products to determine the best value for DOL. Through a competitive solicitation, the FEITH BridgeLogIQ records management platform was purchased for implementation. For the past two years, DOL has completed multiple phases of implementation, configuration, and feature development for the FEITH BridgeLogIQ platform.
Implementing the FEITH BridgeLogIQ electronic records management platform requires continued professional services and software maintenance.
FEITH is the sole developer of FEITH BridgeLogIQ and is the only certified service provider capable of providing necessary customizations and feature updates as required by DOL. FEITH has an extensive service capability to conduct an implementation of this magnitude. They have hands-on experience supporting customers, both large and small, and are the only vendor that can complete the implementation of a records management system developed on the FEITH BridgeLogIQ product. With expertise across all stages of the software integration life cycle, FEITH provides a fully integrated team.
By allowing FEITH to provide ongoing maintenance and support for implementation, the program will be able to link important sources of electronic permanent records, such as Exchange Online, to the existing FEITH Electronic Records Management System. Without these connections, DOL is at risk of prematurely disposing of, or losing permanent records, violating the Federal Records Act and creating significant risk for DOL agencies. Accurate, authoritative, and properly retained records are crucial to fulfilling many agencies mission areas. Without expert implementors and ongoing software maintenance, the DOL records management program cannot fulfill these essential functions for the DOL sub-agencies. If this requirement is not awarded to FEITH, DOL would need to acquire a different electronic records management platform from another manufacturer, leading to unacceptable delays and costs.
DOL, to date has invested over $2 million into the development of its records management platform capabilities with FEITH BridgeLogIQ. Switching to another platform would cost DOL an additional $2 million for software and support services. Any alternative would result in significant costs and DOL not being able to meet the deadlines of OMB Memoranda M-19-21 and subsequent M-23-07.
5. DETERMINATION BY THE ORDERING ACTIVITY THAT THE ORDER
REPRESENTS THE BEST VALUE FAR 8.404 (d)
Feith Systems and Software, Inc. currently has a General Services Administration (GSA) MAS contract, 47QSMA19D08NH, and the Contracting Officer will conduct a price analysis on the price quotation to ensure that proposed pricing is fair and reasonable and that it provides the best value to the Government. Furthermore, the Contracting Officer will ensure the labor mix and hours proposed is suitable for this effort.
6. A DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS
OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT
CONDUCTED
DOL has conducted market research utilizing several Government-wide Acquisition Contracts and found there are no other vendors capable of providing these services. Market research revealed that Feith Systems and Software, Inc. is the manufacturer and the only vendor that possesses the extensive knowledge and experience to provide continuing support for DOL eRMP.
7. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION
Through a competitive process, the government awarded a contract to AASA Inc., a small business, to provide necessary software and professional services to implement an electronic records platform based on the FEITH BridgeLogIQ software. Performance of the contract was provided at a satisfactory level, however, in April 2024, DOL was informed that AASA Inc.
would no longer be able to provide the required FEITH BridgeLogIQ software maintenance or authorized professional support services. As a result, DOL was unable to exercise the option period with AASA Inc. and must procure the necessary services from an alternative source.
FEITH is the sole manufacturer of the FEITH BridgeLogIQ software. There are no third-party companies, resellers, authorized or unauthorized, that provides this software or service.
8. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY
SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE.
The Government will continue to conduct market research and consider similar services as they become available to determine if they meet agency requirements. There are no other known barriers to competition for this requirement.
