DEPARTMENT OF DEFENSE
WASHINGTON HEADQUARTERS SERVICES
1155 DEFENSE PENTAGON
WASHINGTON, DC 20301-1155
ACQUISITION DIRECTORATE
June 22, 2021
Control No. WHS-2021-0141
JUSTIFICATION FOR LIMITED SOURCE JUSTIFICATION (LSJ)
UNDER FEDRAL ACQUISITION REGULATION SUBPART 8.4
1. AGENCY AND CONTRACTING ACTIVITY: The Department of Defense, Washington Headquarters Services, Acquisition Directorate; The Department of Defense
(DoD), Office of the Secretary of Defense, Directorate of Cost Assessment and Program
Evaluation (CAPE)
2. DESCRIPTION OF ACTION: WHS AD proposes to issue an extension of services under contract number GS-00F-022CA, task order number HQ0034-16-F-0073, using a firm fixed price structure, to the incumbent, Leidos, Inc, without using full and open competition. The current task order expires on July 05, 2021. The effort is to continue providing Joint Data Support (JDS) to the Cost Assessment and Program Evaluation for the
DoD. The period of performance for this extension will be from July 6, 2021 to October 5, 2021 with a total estimated dollar value of $782,000.00. The 3-month extension will be funded with O&M funds from Fiscal Year 2021.
The current task order was issued by WHS/AD on July 06, 2016 with a period of performance of July 06, 2016 to July 05, 2021. An extension of services, in accordance with FAR 52.217-8 “Option to Extend Services” or otherwise, is necessary to prevent a lapse in support to JDS. This requirement is currently being re-competed with an anticipated award October 05, 2021. Therefore, this Limited Sources Justification (LSJ) seeking approval to extend services to Leidos, Inc, which would continue the same services provided under the current contract until the new anticipated contract is awarded no later than October 05, 2021.
3. DESCRIPTION OF SUPPLIES/SERVICES: The objective of this effort is to provide data development, analysis and information technology support to implement JDS activities associated with the Department of Defense’s Analytic Support to Force Planning as well as other Department leadership directed study and analysis requirements. JDS Support Service including General - Data Acquisition. Data Documentation & Management, Support
Studies and Analysis, System and Network Administration and Management, Infrastructure and Information Technology Security Support
4. CIRCUMSTANCES JUSTIFYING LIMITED SOURCES: In accordance with FAR
8.405-6(a)(1)(i)(C), in the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order, which was placed under the
Federal Supply Schedule ordering procedures.
Failure to extend services would result in a substantial duplication of cost to the
Government. The substantial duplication of cost is estimated at $700,000 which is not expected to be recovered through competition. The estimated dollar cost of $700,000 includes approximately 6,000 hours and 13 contractor personnel, or more, needed from another vendor to provide these services to CAPE and Joint Staff.
Awarding services to a contractor other than Leidos for three months of performance would entail multiple transitions between potential vendors (incumbent vendor, temporary vendor, and new long term vendor), which involves the Government paying multiple vendors for the transition of different contracts for continuous support services.
These multiple transitions, going from extension of services, to award of a new contract, involves additional resources and unnecessary costs for the Government, and can cause unacceptable risks, delays and interruptions in services. Therefore, an extension to Leidos contract is needed to continue providing services while the Government is working a competitive acquisition in which has an anticipated award date of September 2021. A work stoppage in support is unacceptable. In order to maintain continuity of services, an extension of services is the most logical and cost effective solution to the Government
Furthermore, failure to extend the services will create a lapse of analytic and cost assessment support, System/Network Administration, and Management/Security
Management, which is critical to the effective operations of both CAPE and Joint Staff.
These support services are vital. Not continuing the services would cripple JDS’s ability to provide data and manage analytic information on behalf of the Department’s analytic community at a critical time in which the Deputy Secretary of Defense has directed Force
Capability analysis to be completed before the next Program Review cycle, beginning in late August 2021. These work stoppages will hinder and directly impact the DoD’s ability to provide support identifying, collecting, developing, analyzing, managing, and disseminating historical, current and future years U.S. and non-U.S. forces inventory, capabilities and deployment data (including planning, programming and acquisition data) supporting collaborative study teams led by the Joint Staff and OSD CAPE.
5. BEST VALUE DETERMINATION: The Government will ensure that the final negotiated price is fair and reasonable in accordance with FAR 15.404-1-“Proposal
Analysis Techniques.” The Government will compare proposed prices set forth by Leidos to historical prices paid by the Government under the current task order. The Government will also compare the proposed prices with prices obtained through market research for the same or similar services. The Government will also compare the proposed prices with the
Independent Government Cost Estimate prepared for the task order extension.
6. MARKET RESEARCH: On May 20,2021 Washington Headquarters Services issued a
“Notice of Intent to Extend” the active task order on beta.SAM.gov. The Notice of Intent was posted for 15 days and closed on June 4, 2021. Based on the Notice of Intent, no vendor challenged the extension task order with Leidos, Inc. As previously mentioned, the
Government will conduct a competitive acquisition, which is scheduled for award in no later than October 05, 2021.
7. OTHER SUPPORTING FACTS: WHS/AD will solicit this effort as a task order extension in order to maintain continuity of support for all of JDS Support. The task order extension will be issued as the most logical and cost effective strategy and solution to the
Government which will avoid duplicative costs and unacceptable delays in fulfilling the agency’s requirement and a potential gap in performance of critical services while a competitive acquisition occurs.
FAR 52.217-8 was included in the solicitation and was included as part of the evaluation factors. In addition, while we believe FAR 52.217-8 was likely evaluated, we no longer have access to the price evaluation and cannot confirm that that was the case. Accordingly, we have prepared this justification in the alternative.
8. ACTIONS TO REMOVE OR OVERCOME ANY BARRIERS THAT LEAD TO
THE RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT
ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE:
(a) Efforts to obtain competition: A competitive acquisition is currently being conducted by WHS AD, and the anticipated award date for the new contract is scheduled for January
9. If this acquisition is for new work as a logical follow-on to on original Federal Supply
Schedule (FSS), was the original order was placed under the FSS ordering procedures?
