This acquisition is conducted under the authority of the Multiple Award Schedule Program.
1. Contracting activity/agency. Department of the Interior, Interior Business Center, Acquisition Services Directorate, of behalf of The Morris K. Udall and Stewart L. Udall Foundation.
2. Description of supplies or services required to meet agency needs.
The Environmental Protection Agency (EPA) Headquarters has coordinated with the
National Center for Environmental Conflict Resolution (NCECR) to engage tribes in capacity building and developing cross-tribal forums on wetlands management. This contract will facilitate workshops and trainings for tribes, ongoing communications for the regions of Northern Great Plains and Rocky Mountains regions. 3. Identification of the limited source(s) to be solicited.
Consensus Building Institute, Inc.
100 Cambridgepark Drive Cambridge, MA 02140-2369
4. Reason for authority cited. The contracting officer has determined the circumstances of the action deem it necessary to limit the source.
FAR 8.405-6 (a)(1)(i)A - An urgent and compelling need exists, and following the procedures would result in unacceptable delays.
5. Rationale.
There is an urgent need for the Government to procure these services for capacity building and developing tribal forums on wetlands management as delays under the current effort, D15PC00210, were experienced due to COVID-19 related complications. There would be significant cost and schedule delays to the Government following competitive procedures. Any new contractor would be duplicating work and efforts that were already accomplished under the previous contract at additional cost to the Government. These costs have been estimated to be over .
The Consensus Building Institute, who initially developed the training under the current contract D15PC00210, is uniquely positioned to deliver this in a cost effective and time efficient manner to address the needs of The Morris K. Udall and Stewart L.
Udall Foundation. As the sole provider of these services over the last five years to the Government, the company is exceptionally experienced to provide the best value to the Government.
6. Market Research.
Market research was conducted on the field of providers for the Facilitation Services through the National Roster of Environmental Conflict Resolution Professionals (https://www.udall.gov/OurPrograms/Institute/Roster.aspx). The previous acquisition history was also reviewed as the System for Award Management (SAM), PPIRS, and Contractor Performance Assessment Reporting System (CPARS) at CPARS. Of those ECR roster members, there are at least five (5) individuals or firms that can perform this work, including Consensus Building Institute (CBI). These individuals and firms have demonstrated experience in working with tribes and wetlands in the American West. Market research was also based on a review of similar General Service Administration (GSA) Advantage schedules for Environmental Conflict Resolution.
However, as there is an urgent need for the Government to procure these capacity building and developing tribal forums on wetlands management services, only CBI was found to be able to do so in a timely and cost efficient manner. Any new contractor would be duplicating work and efforts that were already accomplished under the previous contract. CBI, who hold the current contract D15PC00210, is uniquely positioned to deliver in a cost effective and time efficient manner to address the needs of the Morris K. Udall and Stewart L. Udall Foundation under the EPA Tribal Wetlands Management Coordination Services requirement. Under the authority of FAR 8.405-6, the undersigned hereby determines the circumstances of this action deem only one source is reasonably available as supported herein.
