LIMITED SOURCE JUSTIFICATION (LSJ)
1. IDENTIFICATION OF AGENCY AND CONTRACTING OFFICE
Agency: Social Security Administration (SSA)
Contracting Office: Office of the Deputy Commissioner for Budget, Finance, and Management Office of Acquisition and Grants (OAG) Office of Operations Contracts (OOC) Division of Facilities Contracts (DFC)
Contracting Officer (CO): Christopher Brennan / 410-966-0392
Program Office: Office of the Deputy Commissioner for Budget, Finance, and Management Office of Facilities and Logistics Management (OFLM)
Office of Environmental Health and Occupational Safety
(OEHOS)
Contracting Officer’s Zachary Hepler / 410-965-1166 Technical Representative
(COTR):
Title: Environmental, Health, and Safety Services (Bridge Task
Order)
Proposed Contractor: Advanced Technologies and Laboratories International, Inc.
2. NATURE AND DESCRIPTION OF ACTION
We seek approval of an LSJ to award a bridge task order to Advanced Technologies and Laboratories International, Inc. (hereinafter “ATL”) for environmental, health, and safety services at the agency’s headquarters facilities located in Baltimore, MD. SSA requires these services for the safe operational use of these facilities, which is part of the agency’s critical infrastructure. Currently, we receive these professional services from ATL through an Interagency Agreement (IAA) between SSA and the Department of Health and Human Services, Program Support Center/Federal Occupational Health (hereafter referred to as “PSC/FOH”) under IAA agreement PHS-20-0004. However, SSA was recently notified that PSC/FOH would no longer perform these services under the IAA for the agency’s headquarters facilities after November 17, 2020. Due to the critical nature of these services, an urgent and compelling circumstance exists for the agency to procure bridge services from ATL. We contemplate a period of approximately nine (9) months of bridge services to facilitate the establishment of a five-year competitive procurement. The bridge award will ensure continued protection of the agency employees and contractors working at the headquarter facilities in Baltimore, MD.
3. DESCRIPTION OF SUPPLIES OR SERVICES AND ESTIMATED VALUE
The proposed task order will provide environmental health, safety, management, and industrial hygiene services including performing environmental sampling of air, water, soil, and process by-product & waste materials for the headquarters facilities. The task order will require the vendor to furnish all necessary management, supervision, labor, materials, supplies, and equipment to plan, schedule, coordinate, and assure effective performance of all safety, environmental and industrial hygiene services, as detailed in the Statement of Work and applicable attachments.
The estimated value of this nine-month action is $425,500.
4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING LIMITING
SOURCES
FAR 8.405-6(a)(1)(i)(A) – Urgent and Compelling Need
The agency’s need for the services identified herein is of such an urgent and compelling need that the Government would incur unacceptable delays if not permitted to limit the number of sources from which it solicits quotes. Consequently, full and open competition is not required.
5. CONTRACTOR’S UNIQUE QUALIFICATIONS
ATL has been successfully providing these services on the current and prior IAA with PSC/FOH. Due to its current experience providing environmental, health, and safety services at the headquarters facilities, ATL possesses the unique ability to provide an expedited service transition with minimum disruption in performance and safety readiness. Furthermore, ATL can rapidly be awarded a General Services Administration (GSA) task order to perform, as the required services are available on its GSA schedule GS-00f-067CA, which covers the entire period of performance for this bridge task order.
6. EFFORTS TO SOLICIT OFFERS FROM OTHER POTENTIAL SOURCES
Due to the urgency of this requirement, we made no efforts to solicit from other sources.
Following award of a short-term bridge task order, we will competitively solicit this requirement and facilitate vendor interest through posting of the solicitation on GSA e- Buy website and other market research tools.
7. DETERMINATION THAT THE PRICE WILL BE FAIR AND REASONABLE
Per FAR 8.405-2(d), we will determine a fair and reasonable price via a comparison of the proposed price with ATL’s GSA schedule prices including evaluating the level of effort and labor mix proposed.
8. MARKET RESEARCH
Per FAR 10.002(b)(2)(i), we performed market research by contacting knowledgeable individuals in the agency (e.g. the COTR) regarding market capabilities to meet our requirement. Since ATL is currently performing these services successfully, the agency conducted no further market research.
9. OTHER FACTS SUPPORTING USE OF LIMITING SOURCES
As noted in Section 2 of this document, the absence of environmental, health, and safety services at the agency’s headquarters facilities could negatively affect the health and safety of agency personnel, and could possibly lead to a closure of the headquarter facilities until environmental, health, and safety services could resume.
10. LIST OF SOURCES EXPRESSING INTEREST IN THE ACQUISITION
We have not received interest in performing this requirement from any other sources.
Due to unusual and compelling urgency (see Section 4), we intend to negotiate solely with ATL for the award of a short-term bridge task order.
11. ACTION TAKEN TO REMOVE COMPETITIVE BARRIERS
As referenced in Section 2, this action will ensure that the agency does not experience a lapse in these critical services. A short-term bridge award will provide support while we re-compete this requirement and is therefore considered a one-time action. We anticipate releasing a competitive solicitation for these services in March 2021, and subsequently awarding within three months after release of the solicitation.
