Limiting Sources (<SAT)

Acquisition Plan Action ID: 36C241-20-AP-2030

1. Contracting Activity: Department of Veterans Affairs, VISN 01, Station 523, VA Boston Healthcare Systems 940 Belmont Street Brockton, MA 02301-5596 Transaction Number: 523-20-3-7878-1313 VA Boston is requesting 100,000 AAMI Level 2 Isolation Gowns

2. Description of Action: VA Boston is requesting the procurement of 100,000 AAMI Level 2 Isolation Gowns.

Order against: FSS Contract Number: V797P-4306B

Name of Proposed Contractor: Phoenix Textile Street Address: 21 Commerce Drive City, State, Zip: O’Fallon, MO 63366-4413 Phone: 800-727-3035

3. Description of Supplies or Services:

The estimated value of the proposed action is $ 587,000 for 100,000 AAMI Level 2 Isolation Gowns. This supply has been purchased before but due to the COVID-19 pandemic there is a nationwide shortage. American Medical Depot (Prime Vendor), ICP and Precept Medical were contacted. However, they do not have the quantities available, are on backorder, or we are on a limited allocation. Phoenix Textile, a woman owned small business, is able to supply the requested quantity. This requirement was searched under NAICS code 339113, PSC code 6515 from the NAC FSS contract V797P-4306B with 0 results. Using the best fit NAICS 315210, PSC 6532, I still yielded 0 results. I conducted a Dynamic Small Business Search using NAICS 315210 and Level 2 Isolation gowns which also resulted in 0 results.

4. Authority:

Order Against FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:

An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);

Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

(FAR 8.405-6(a)(1)(i)(B));

In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405- 6(a)(1)(i)(C)); or

Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).

5. Rationale/explanation to support cited authority:

6. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.

This is an EMERGENCY procurement in support of COVID-19 operations. There is a nationwide shortage of AAMI Level 2 gowns and they are necessary for the health and safety of our patients and staff. The Prime vendor, American Medical Depot, does not have the quantities needed available.
