IDENTIFICATION OF STATUTORY AUTHORITY
This acquisition is conducted under the authority of the Multiple Award Schedule (MAS) program. The primary statutory authorities for MAS are Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, et seq.) and Title 40 U.S.C.
501, Services for Executive Agencies. The circumstances and rationale for limiting consideration to select schedule contractors for award follows:
FAR 8.405-6(a)(1)(i)(B)-Only one source is capable of providing the supplies or service required at the level of quality required because the supplies or services are unique or highly specialized.

Market Research shows several manufactures make tactical armored security vehicles however; only one (1) meets all of the minimum requirements established by CBP to maintain safety in life threatening situations. Currently, Lenco’s Bearcat G3 is the only known model capable of meeting the OSPB Level E requirement, the Aberdeen Performance Testing requirement and has the shortened wheelbase.
OSPB requirement-These vehicles must be Overseas Security Policy Board (OSBP) compliant to enable International Cooperative Administrative Support Services (ICASS) for vehicle and armoring repairs through DOD Chief of Mission in the specific foreign country where they are assigned. This is essential to ensure that vehicles may undergo regular routine preventive maintenance and the vehicle or its’ armoring can be repaired when something fails. Limiting the variations and aligning with other armored vehicles that are operated in the specific foreign countries helps meet that criteria through commonality of repair parts and mechanic familiarity with specific vehicles and applied armoring standards.
Aberdeen Performance Testing requirement-This ensures that the armoring requirements are certified to stop incoming projectiles based security needs. This certification also ensures add on items (such as the turret system) maintain the manufactures center of gravity to lessen the possibility of a roll over.
Shortened wheelbase-allows for better maneuverability in tight areas.
These three (3) minimum characteristics have been determined essential to the safe operation and for the protection of life.
With only one manufacturer CBP has become fleeted with Lenco Bearcats. One of the advantages of being fleeted with Lenco vehicles comes from the requirement for each vehicle operator to be trained and certified with each vehicle to the point that they are experts in functionality, maneuverability, operation and mechanical ability. Each operator must know the vehicle well enough to operate safely in life threatening situations. Limiting to one make of vehicle has allowed CBP to create a single Standard Operating Procedure (SOP), training guides, training programs and certification requirements.
Additionally, introducing a new manufacturer's product at this time would incur a duplication of cost to the Government by requiring the creation of a new inventory of another manufacturer's spare parts which forces the end user to inventory, manage, and maintain replacement parts from multiple manufacturers. Maintaining an inventory of hardware and accessories for multiple brands is redundant and cost inefficient because purchasing smaller quantities of multiple brands of vehicles eliminates the purchasing power afforded by larger quantity orders of a single vehicle by splitting CBP’s demand thereby compromising the Government's ability to leverage its buying power. As a result, the Government would pay more for the redundancy of multiple brands than for the standardization of a single vehicle.
The primary rationale for limiting the source to the Lenco Bearcat G3 is based on the minimum requirements for drivability and safety outlined above. Secondly, CBP has become fleeted with Lenco Bearcat G3 which has created scales of efficiency in being able to provide training and certification programs based on only one vehicle. Lastly, being fleeted with Lenco Bearcat G3 has created logistical efficiencies in the ability to store and maintain working spare parts for distribution when required.
For these reasons, CBP requests limited sourcing and procurement to the Lenco Bearcat G3 specific vehicle.

DESCRIPTION OF THE MARKET RESEARCH CONDUCTED
Market research has indicated that there are currently twenty-one (21) small business contractors listed under SIN 426 5B. Although there are twenty-one (21) businesses listed only one (1), manufacturer sells the Lenco Bearcat G3.
Additional research was conducted and it was determined that none of the other twenty-one (21) could meet all of the minimum requirements, namely the OSPB Level E requirement, the Aberdeen Performance Testing requirement and the shortened wheelbase . Based on the market research conducted it has been determined that although other manufacturers exist only the Lenco Bearcat G3 is capable of meeting all of CBP’s required salient characteristics for tactical armored vehicles.
