OPOAM 3008.405-6(a)(2) Limited-Sources Justification (LSJ)
LSJ No: FY20-00109 - 1 -
LSJ No.: FY20-00109
This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C.
152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.
1. Agency and Contracting Activity. Identification of the agency, contracting activity, and specific identification of the document as a “Limited-Sources Justification.”
The Department of Homeland Security, Office of Procurement Operations (OPO), Cybersecurity and Infrastructure Security Acquisition Division (CISAAD) and Infrastructure Security Division (ISD), Office of Chemical Security (OCS) proposes to award a task order pursuant to FAR 8.405-6(a)(1)(i)(B), Limiting Sources.
2. Nature and/or description of the action being approved. Describe the action being approved and include the name and address of the proposed contractor(s).
DHS/OPO intends to limit the number of sources solicited pursuant to FAR 8.405-6(a)(1)(i)(B) for the procurement of services to upgrade and maintain software due to unique and highly specialized services required by the Proposed Contractor:
Sierra Nevada Corporation (SNC) 444 Salomon Circle Sparks, NV 89434
Award is to be made through SNC’s General Service Administration (GSA) contract 47QTCA19D006Y. It has been determined that SNC’s GSA contract has sufficient remaining term, including options, to cover the anticipated period of performance for this requirement.
3. Description of Supplies/Services. Describe the supplies or services to be acquired. Provide the estimated total value (including options, if any).
The requirement is to provide integration and operations and maintenance (O&M) support services for the Chemical Security Assessment Tool (CSAT) suite at a total cost of
CSAT is a java-based software code written by SNC. SNC is the only source that can complete the integration and provide the O&M support at this time.

4. Authority and supporting rationale.
In accordance with FAR 8.405-6(a)(1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. This work is highly specialized and unique it involves two software tools that is used by the Office of Chemical Security (OCS). The software used are Chemical Security Assessment Tool Suite (CSAT) and Chemical Security Evaluation and Compliance System (CHEMSEC). CSAT is a java-based code written by SNC. This code is then integrated into the case management tool, CHEMSEC which SNC needs to complete. Upon completion of the integration, SNC is well-suited to expeditiously take on the operations and maintenance (O&M) role prior to DHS competing a new effort for the O&M support services, which was initiated in early January and has a July/August estimated award date.
The work, which consisted of the development of the java-based code and the integration of it, was initially started under an Interagency Agreement (IA) with Department of Defense (DOD) (a sole source Board agency announcement (BAA), W911NF-12-R-0011). However, the servicing agency exceeded its funding limit under the BAA in November 2019 and was not able to add additional funding to complete the integration of the CISA/OCS effort. Only SNC can do the integration because they developed the software code, which will take approximately 1 to 2 months to complete.
Then, the government estimates that it will need at a minimum 2 to 3 months of O&M before the long-term O&M task order can be awarded pursuant to competition. Any vendor other than SNC would not be able to start the O&M work without being trained by SNC because SNC developed the software code and have the knowledge and skillset to complete the training/transition, which would take 2-3 months.
The lack of support could result in loss of mission critical tools.
SNC’s knowledge of building and maintaining these tools is critical to current operations and the transition to the follow-on contractor to ensure uninterrupted services.
5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).
The Contracting Officer has determined that issuing the proposed Task Order to SNC for critical support represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs. This order will be placed in accordance with FAR 8.404, “Use of Federal Service Schedules.” The General Services Administration (GSA) has already negotiated fair and reasonable pricing rates. Discounts to these GSA schedule rates will be requested. Additionally, prior to issuance of the task order, the ordering activity will consider the
LSJ No: FY20-00109 - 3 -level of effort and the mix of labor proposed to perform the specific task being ordered to determine that the total price is reasonable. The contractor’s labor mix and level of effort will also be compared to the Independent Government Cost Estimate (IGCE).
6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
Market research was not conducted for the completion of the integration effort because only one source can provide the required services at this time. SNC developed the customized java code for the software tools that will be used by OCS for operation and maintenance (O&M) and “bug fixes.”
Due to this customized code, no other source can complete this service, at this time. Hence, as stated under Section 8, the Government is conducting market research for O&M support services to maintain the tools once the integration has been completed.
7. Any other facts supporting the limited-sources justification. Additional facts may be stated in this section. If there are no additional facts, you must state that here.
Not Applicable.
8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made. Include a statement of actions taken or that will be taken to increase competition for future acquisitions of the same item/service (e.g., the government intends to revise overly restrictive technical specifications, acquire data rights, or pursue some other means to increase future competition).
A Request for Information (RFI) was issued on February 26, 2020 for operations and maintenance support services and closed on March 9, 2020. Based on the capability statements received, a competitive buy can be executed for the operation and maintenance support services. The award of the competitive buy will be coordinated with the end of the 3-month base period. This will allow for transition time and ensure uninterrupted services. The government is in the process of procuring a long-term solution to secure the operations and maintenance of the CSAT Suite. This will allow the Government to seek competition in future acquisitions for the same type of support, thus eliminating the barriers for competition.
9. DHS intends to post this requirement on e-buy pursuant to FAR 8.405-6(a)(2)(i).
Not Applicable
