About this file
This document is a Justification and Approval (J&A) for Other than Full and Open Competition for the procurement of two Aesculap Anterior Lumbar Interbody Fusion (ALIF) spinal implant systems. The Defense Health Agency (DHA) Enterprise Medical Support - Contracting Division (EMS-CD) is requesting approval to award a sole-source contract to Aesculap, Inc., the Original Equipment Manufacturer (OEM) of the activeL Artificial Disc ALIF systems.
The Government has a requirement for the ALIF systems to support upcoming spinal implant surgeries at the Naval Medical Center San Diego. Aesculap's ALIF system is the only one that meets the Government's specific criteria, including an endplate design that does not require a keel cut and compatibility with the hospital's existing instrumentation. Market research confirmed Aesculap is the sole source provider of this proprietary system. The estimated value of the procurement is undisclosed, with a proposed delivery date of April 1, 2024 under a Firm Fixed Price contract. The Government will determine price reasonableness prior to award in accordance with FAR 13.106-3.
