About this file

This document is a Limited-Sources Justification (LSJ) for modifying Task Order 70US0922F2GSA2002 on behalf of the Department of Homeland Security U.S. Secret Service (USSS). The modification adds $1,571,185.85 in funding to the current period of performance ending 5/26/2024 to provide relocation management (home sales) services to transferring USSS agents within the continental U.S., Alaska, Hawaii, Puerto Rico, and Guam.

The incumbent contractor, Franconia Real Estate Services, is the only source capable of providing the required highly specialized home relocation services without an unacceptable interruption. The modification is justified under FAR 8.405-6(a)(1)(i)(B) as Franconia is the sole source due to the uniqueness and high specialization of the services. The contracting officer determined this modification represents the best value and lowest overall cost to meet the government's needs, as GSA has already negotiated fair and reasonable pricing.

LSJ Number: FY24-0012 PR Number: PR-24-USSS-2648

Limited-Sources Justification

1. Agency and Contracting Activity.

The Department of Homeland Security, U.S. Secret Service (USSS), Procurement Division, proposes to modify task order 70US0922F2GSA2002, on behalf of Office of the Chief Financial Officer (OCFO) Financial Management Division (FMD), pursuant to FAR 8.405-6, Limiting Sources.

2. Nature and/or description of the action being approved.

USSS requires a modification to task order 70US0922F2GSA2002 to add funding in the amount of $1,571,185.85 to fund relocation services through the current period of performance of 5/26/2024.

Current period of performance expires 5/26/2024.

4. Authority and supporting rationale.

This acquisition is conducted under the authority of Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.

Pursuant to FAR 8.405-6(a), the circumstance that justifies limiting sources to fewer than those required by FAR 8.405-1 and 8.405-2 is:

FAR 8.405-6 (a)(1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

Rationale: As the incumbent, Franconia Real Estate Services is the only source capable of providing home relocation services. The incumbent contractor has the capacity to provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform the relocation management (home sales) services to transferring employees of the USSS. An award to any other source would result in an unacceptable interruption in fulfilling this requirement that would negatively impact the USSS mission.

Additional funding to the current period of performance is required because the expected number of relocations for the period of performance through 5/26/2024 was , however, due to mission-related reason, the number of relocations required through 5/26/2024 is now estimated at . In addition, increases in home sale value, which directly impacts the service fee, contributed to underestimating the funding required for the current period of performance.

5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).

The contracting officer has determined that issuing the proposed task order modification for the continued need of mission critical home relocation services represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs. This modification is against a task order that was placed in accordance with FAR 8.404, “Use of Federal Supply Schedules.” The General Services Administration (GSA) has already negotiated fair and reasonable pricing rates. There is no increase in price associated with this modification and prices were determined fair and reasonable at the time of the task order award. Discounts to these GSA schedule rates will be requested.

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

Market Research was conducted through GSA, DHS Strategic Sourcing Vehicles, and vendor discussions. There are multiple vendors with the capability to fulfil the requirement. Although multiple vendors are known, it has been determined that adding additional funds for the current
