4. Authority and supporting rationale and demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. FAR 8.405-6(a)(1)(i)C - In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule Order provided that the original Order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original Order or BPA was not previously issued under sole-source or limited-sources procedures.
Disruption of the current Program Management support services through re-competition of this requirement would create increased costs and delays to the Government. Such a disruption would delay or halt the current network wireless program management support services provided to DOI. Any interruption in support could affect OCIO and the vendor meeting required milestone dates thus immediately increasing the risk that OCIO will not meet their requirements for wireless network implementation. The MIB Wireless PM support services required by OCIO are critical in accomplishing these deliverables. If this requirement were to be competed using any other vendor than the incumbent, the Government would also incur undue substantial duplication of costs. The period of performance of this effort is up to 12 months; however, failing to continue this requirement with the current vendor would increase this timeline. The time required to transfer knowledge of the OCIO projects currently in progress as part of this requirement to a new vendor to a sufficient level, in order to support the OCIO would be extensive, resulting in increased costs to the Government, as well as excessive time delays in completing these efforts. Incurring these ramp-up costs and delays in performance are not in the best interest of the Government. If this requirement were recompeted, OCIO has determined it would take an estimated three
(3) months for any new Contractor to acquire the institutional knowledge necessary to complete the tasks currently in progress under the current BPA Order, which continue to be required by the OCIO.
Currently, under the current BPA Order D17PB00168, Associated Veterans, LLC provides PM support in providing the above-mentioned end-user support functions. Associated Veteran’s currently possesses the operational infrastructure of personnel who have proven the ability to fulfill the Government’s requirement for wireless network PM support services, allowing the Department to successfully meet its mission. Overall, the institutional knowledge Associated Veterans LLC brings to the wireless network support efforts is critical, and any disruption in the loss of support would greatly impact the progress of ongoing projects causing less efficient work, resulting in significant and costly delays in wireless network operations. Issuing a follow-on order to the incumbent, Associated Veteran’s, who has been working efficiently and continues to deliver a significant number of work products, will avoid the substantial duplication of costs to the Government associated with utilizing a different vendor, as outlined herein.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d). The GSA has already determined that the prices of supplies and services under GSA Federal Supply Schedule (FSS) contracts to be fair and reasonable in accordance with Federal Acquisition Regulation (FAR) 8.404(d). The AQD Contracting Officer (CO) will seek further price discounts and make a separate determination as to the reasonableness of the pricing provided in the quotation, in accordance with FAR 8.404(d). The CO will determine whether the price is fair and reasonable via the use of price analysis with comparison of historical pricing, GSA Pricing, and comparison against the IGE which is based on currently offered commercial prices.
6. Market Research.
Market research for this sole source logical follow-on Task Order is aligned with the market research previously conducted for the recompete of the expired BPAs for Program Management Support. A justification will be approved for a sole source as discussed below.
1. Prior acquisition history reviewed
2. Other recent market research reviewed (RFQ 140D0419Q0038)
3. Government databases reviewed
4. Reviewed existing DOI-wide Enterprise-wide Contracts Vehicles
Market research was conducted under the recompete BPAs for Program Management Support. The BPA market research supports the fact that there are many, capable small businesses that can successfully compete and support the PM requirement for the OCIO under GSA schedules. As of 03/14/2020, the RFQ for the BPAs has yet to be posted.
Through market research, the results have shown that the BPA recompete requirement can be solicited under three (3) GSA Federal Supply Schedules; GSA 00CORP Professional Service Schedule (PSS) Mission Oriented Business Integrated Services (MOBIS) under Integrated Business Program Support Services under Financial, GSA 00CORP Professional Service Schedule (PSS) Mission Oriented Business Integrated Services (MOBIS) under Integrated Consulting Services and GSA Schedule 70 General Purpose Commercial Information Technology Equipment, software and services under Information Technology Professional Services.
The GSA Schedule 70 Information Technology Professional Services vehicle maximizes competition, as there are 1529 eligible Small Business vendors. GSA Schedule 70 hosts vendors that can provide the professional services needed to complete the requirement successfully, such as:
Cloud and Cloud-Related IT Professional Services Introduction of New Information Technology Services and/or Products Wireless Mobility Solutions Information Technology Professional Services
After conducting market research, it has been established that a total small business set aside requirement is suitable and in the best interest of competition and small businesses, to compete the requirement utilizing GSA Schedule 70, under Information Technology Professional Services. Taking advantage of the Schedule 70 vehicle increases the opportunity to drive competition, as there are 1529 eligible small vendors as opposed to the 110 small eligible vendors identified under the GSA PSS FABS schedule. By utilizing Schedule 70, the Government is using best practices to ensure adequate competition and obtain competitive pricing for the requirement.
GSA Schedule set-asides are conducted under FAR 8.405-5 procedures, which states that the ordering procedures at FAR 8.405-1, -2, and -3 must be followed when setting aside an order or establishing a set-aside BPA. At the discretion of the buying contracting officer, orders and BPAs under FAR 8.4 Federal Supply Schedules may be set aside for small businesses for any of the socioeconomic categories listed at FAR 19.000(a)(3), if market research shows that three (3) or more such firms are capable of providing the products and/or services required. If the agency is limiting the number of small business sources considered to fewer than three, as outlined in FAR 8.404 and 8.405, the agency must prepare documentation to justify the limitation.
This requirement for a limited source, logical follow-on with Associated Veterans will be issued utilizing GSA Professional Service Schedule 00CORP, under the Mission Oriented Business Integrated Services (MOBIS) component. Associated Veterans, is the current incumbent, performing successfully under BPA Call Order D17PB00168. This logical follow-on Task Order for Wireless Network Program Management support is a one-time, short-term solution for continued, uninterrupted program management support as new Blanket Purchase Agreements (BPA) for Program Management Support are competed. Once the period of performance (no more that one (1) year) for this follow-on Task Order ends, this requirement will be re-competed under the new BPAs.
7. Any other facts supporting the justification.
OCIO requires continuity of operations during the recompete of the multiple award, small business set-aside BPAs as the BPAs will not be executed until after the current BPA Order (D17PB00168 Option Period 4 Expires 05/02/2020) for OCIO PM service support ends. It is anticipated that the new BPAs will be in place by June 2020.
In the interest of economy and efficiency, it is in the Government’s best interest to issue a logical follow-on for this work to Associated Veterans. GSA E-Buy will not be utilized as this is a sole source, logical follow-on, Task Order to a specific vendor.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for supplies and services is made.
Division 1, Branch 2 of the AQD Herndon Office is currently supporting the effort to solicit a 5-year, competitive, small business set-aside, multiple award BPA to obtain PM services.
9. The ordering activity contracting officer’s certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief. I certify this justification is accurate and complete to the best of my knowledge and belief. Under the authority of FAR 8.405-6, the undersigned hereby determines the circumstances of this contract action deem only one source is reasonably available as supported herein.
Contracting Officer
10. Evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government’s minimum needs or requirements or other rationale for limited sources) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel. I certify the technical data which forms a basis for this justification is complete and accurate and meet the Government’s minimum needs.
