6. Pursuant to FAR Subpart 13.106-1 (b), the Contracting Officer may solicit from one source if they determine that the circumstances of contract action deem only one source reasonably available:
Check the appropriate reason below:
X Only one responsible source and no other supplies or services will satisfy agency requirements, i.e. Unique capabilities, Limited number of sources, Proprietary data or Brand Name Mandatory ___ Unusual & Compelling Urgency ___ Exclusive Licensing Agreements ___ Industrial Mobilization/Standardization
7. Impact Statement (describe the impact on the mission or property) STONE’s Stern Door Modify Repairs are required for the safe and continued operation of the stern doors onboard CGC STONE during small boat launch and recovery. All parts on PR were identified as required parts to improve the operations of the stern door onboard CGC STONE as per the drawings. Reliable closing and opening of the stern doors on WMSL fleet is essential to maintain a fully mission capable USCG asset and will increase safety of small boat operations. Parts supplied by Walz and Krenzer, Inc. are in accordance with ship’s drawing and configuration material parts list.
8. Explain why an adequate purchase description or other information suitable to solicit by Full and Open Competition has not been developed or are not suitable.
The material to be procured is available from Walz and Krenzer Incorporated, which owns all rights to the proprietary data, specifications, and drawings. No other suppliers currently have the capability to provide the required stern door without the proprietary technical details. Only brand name/OEM parts will satisfy all requirements for the safe operation of the stern doors. The Coast Guard did not purchase the manufacturer's proprietary data rights, and therefore, cannot determine with certainty that an alternative part number would mount to, interface with, or operate effectively with the installed system. No other brand will work. The OEM part numbers required:

9. Provide a Statement of Actions, if any, the government may take to remove or overcome any barriers to competition before future acquisitions are required.
Walz and Krenzer, Inc. is the OEM for the stern doors onboard WMSLs. Add some of the high demand items as a CG stocked item to avoid long lead times. The Coast Guard will continue to work on obtaining the proprietary rights to the data in an effort to identify alternate parts/vendors that are able to meet the Coast Guard's needs.
