Sole Source Justification and Approval for Other than Full and Open Competition

Value Engineering Study Support Niagara Falls Storage Site

1. Contracting Agency: U.S. Army Corps of Engineers, Buffalo District, Contracting Office

(CECT-LRB).

2. Contracting Activity: Buffalo District Corps of Engineers Contracting Office will solicit, award, and manage the supply purchase as a standalone firm fixed price contract.

3. Description of Action: USACE Buffalo District is conducting a Value Engineering (VE) Study Workshop from 29 Jan – 02 Feb 2024 at the District HQ and the Niagara Falls Storage Site (NFSS) in support of the ongoing FUSRAP project. Waste Control Specialist LLC (WCS) is the only location that can accept the materials from the NFSS site. USACE Buffalo is hiring WCS to provide subject matter expertise during the workshop to provide efficiencies of effort and identify unknowns that will assist with future planning efforts.

4. Authority: FAR 6.302-1(a)(2) states: when the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.

5. Need for Justification: During the initial market research for this requirement, it was determined that there were only two facilities that may be potential receiving sites for the materials stored at NFSS. Those facilities were: Waste Control Specialist LLC (WCS) in Andrews County, Texas and Energy Solutions in Clive, Utah. Energy Solutions has limited capacity to accept this material. A downgrading process is required to make the materials acceptable for transport. This process greatly increases the volume of the material and far exceeds Energy Solutions capacity; therefore, it was determined that Energy Solutions could not accept the materials from NFSS.

6. Description of Supplies/Services:

A Value Engineering (VE) Study will be performed on the Preliminary - 30% Niagara Falls Storage Site (NFSS) Integrated Waste Containment Site (IWCS) Operational Unit (OU) Remedial Disposal (RD) submittal during 29 January through 02 February 2024.

The VE Study Workshop will be facilitated by others. The final report of findings from the VE Study will be prepared by others.

Participation by WCS at the VE Study Workshop will be as follows:

• WCS will participate in a pre-workshop preparation conference call, anticipated to be up to two (2) hours. The call will utilize Webex and the link will be provided by USACE PM.

• WCS will provide virtual representation for the first two (2) days of a five (5) day Value Engineering Workshop, to be facilitated under separate USACE contract, held at the Buffalo District Office and/or at the NFSS. Hours are 0730-1630 daily.

• WCS will select the appropriate managerial and technical personnel from their organization to virtually attend the VE Study Workshop. For purposes of the proposal, assume up to five

(5) WCS personnel will attend virtually.

WCS will maintain detailed notes of the VE Study Workshop discussions, decisions, and other activities and electronically submit a written summary of issues related to retrieval, processing, containerization, transportation, and disposal, and WCS recommendations to address such issues to USACE for review within ten (10) business days following completion of the VE Study Workshop.

7. Fair and Reasonable Cost Determination and Approval:

I hereby determine that the anticipated cost for this contract action will be fair and reasonable. Cost analysis will be performed prior to contract award. It is anticipated these services will not exceed $ 25K.
