About this file

This document is a Class Justification and Approval (CJ&A) for a sole-source delivery order awarded to Lockheed Martin Corporation - Missiles Fire Control (LMMFC) under a Basic Ordering Agreement (BOA) to support United States Navy (USN) F-35 Tactical Missile Operational Flight Program (MOFP) development. The CJ&A provides details on the market research conducted, the determination of fair and reasonable pricing, and actions to remove barriers to future competition. The related federal contract opportunity is for the LRASM MOFP Development, awarded to LMMFC on a sole-source basis under the authority of 10 U.S.C. 2304(c)(1) and FAR 6.302-1. The delivery order is valued at $3,369,183.00 and was awarded on May 30, 2024. The acquisition strategy for the follow-on OASuW Increment 2 requirement is currently structured as a Middle Tier Acquisition rapid prototyping program with a planned flight demonstration in FY27.

CJ&A-19-0004

Amendment 01

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The notice required by FAR 5.201(b) will be released to Federal Business Opportunities (FedBizOpps) for the LRASM C-3 order to be placed under the BOA. Any inquiries received as a result of the notice will be given full consideration prior to award. In support of awarding the BOA, the Navy conducted market research by surveying Industry to gain knowledge of various solutions that could meet the OASuW Increment 1 requirement. A Sources Sought required by DFARS 206.302(d) was released on 10 September 2018. A synopsis required by FAR 5.201(b) was released on 26 September 2018 to FedBizOpps for the first planned BOA order. No responses to either announcement were received.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this CJ&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

The Navy is presently executing the OASuW Increment 1 requirement. An OASuW Increment 2 requirement, currently in development, will address the advanced maritime threat. The acquisition strategy for Increment 2 HALO system is currently structured as a Middle Tier Acquisition rapid prototyping program with a flight demonstration planned in FY27. The Increment 2 HALO MTA is planned as a competition for multiple launch platform capabilities (air, surface, and subsurface). It is important to note, the LIP effort and associated ECPs, such as C-3, are associated with Increment 1’s CDD and are not linked to Increment 2.

If another potential source emerges in response to order synopses for OASuW Increment 1, NAVAIR will assess whether competition for future requirements is feasible. NAVAIR plans to include relevant technical data and computer software clauses and enforce those clauses to ensure that the Government receives any necessary license rights on an order by order basis.

As this is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(S-70)(i), the prior J&A was provided to the approval authority for review. Approval of this J&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(S-70)(ii).
