FEDERAL BUREAU OF INVESTIGATION
JUSTIFICATION FOR LIMITED
COMPETITION/SIMPLIFIED ACQUISITION
JUSTIFICATION AND APPROVAL FOR
ACQUISITIONS UNDER THE SIMPLIFIED ACQUISITION THRESHOLD
In accordance with Federal Acquisition Regulation 13.106-1(b)(1), I hereby determine that the aLoksak & CBRNE Evidence Bags listed on DJF-21-0700-PR-0001639 are available from only one manufacturer (brand name only), and competition is precluded as there are no substitutes available.
1. This acquisition is restricted to the following manufacturer:
Company: Loksak
Company Address PO Box 7127 Naples, FL 34101
Company Point of Contact and Phone Number: 239-331-5550
2. The aLoksak & CBRNE Evidence Bags is estimated to cost $22,985 and is required to be delivered by 5/14/2021.
The aLoksak & CBRNE Evidence Bags are currently in use throughout the FBI in HazMat operations. This requirement is to replace dwindling supplies of the operational approved item. The SRAU must be able to safely secure hazardous evidence during all phases of evidence collection operations. The SRAU has successfully employed aLoksak bags for the preservation of evidence and the containment of hazardous evidence in the most commonly found forms (liquids, solids, semi-solids, body parts, etc.) .Specific characteristics of the Loksak brand waterproof bags that limit the availability to a brand name are aLoksak bags differ from ordinary “zipper seal” style bags in that they hold patents in areas that allow for waterproof at depths, leak proof seams, and thicker plastic film construction that will stand up to chemical decontamination. The leak-proof seal and waterproof certification are critical for the preservation of evidence which must be decontaminated prior to transfer to FBI evidence technicians and transportation to FBI partner laboratories.

A patent, copyright, proprietary data, or licensing agreement limits competition. The proprietary data are described as follows:
Loksaks aLoksak bags hold 5 patents related to their bags in the zipper, seals, and film areas. The CBRNsak bags hold a patented film with barrier and odor-proofing capabilities. The aloksak bags allow for a reusable zipper style waterproof to depths bag, the CBRN is rated to keep 100% of liquid in and out along with both types allowing for heat resistance.
These are "direct replacement" parts/components for existing equipment.
Other information to support a brand name only buy:
The HERT/HERC Teams are not authorized to collect hazardous evidence in any other type of bags other than the operationally approved Loksak bags that the SRAU response personnel provide.
