About this file
This document is a Single Source Determination using Simplified Acquisition Procedures (SAP) for an emergency glider recovery. The Department of Commerce's National Oceanic and Atmospheric Administration (NOAA) requires a commercial passenger fishing vessel to urgently recover a distressed glider drifting approximately 140 miles offshore. The estimated performance period is June 21-24, 2024 with a total estimated contract value of $34,000. Market research determined that only one vessel, the M/V Merlin, has the necessary fuel capacity, equipment, and availability to meet the government's minimum needs within the required timeframe. A competitive procurement would result in unacceptable delays and risk losing the $450,000 glider. NOAA intends to negotiate a sole source contract with Merlin Marine Corp under the simplified acquisition authority.

SINGLE SOURCE DETERMINATION USING
SIMPLIFIED ACQUISITION PROCEDURES (SAP)
FOR AN ACTION NOT EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD
(AUTHORITY: FAR 13.106-1(b)(1))
143051-24-0134
1. Agency and contracting activity. Department of Commerce, NOAA Acquisition and Grants Office (AGO), National Marine Fisheries Service (NMFS), Southwest Fisheries Science Center (SWFSC), and Ecosystem Science Division (ESD).
2. Description of supplies or services required to meet agency needs (including the estimated value).
ESD needs to charter a commercial passenger fishing vessel for a glider that was deployed five miles off the coast of Oceanside, CA, on May 30, 2024 is in distress and requires an emergency recovery. The estimated performance period will be from Friday, June 21 – Monday, June 24, 2024.
This will be a firm fixed price contract with no option years. The contract has a total estimated value of $34,000.
3. Identification of the single source or the brand name to be solicited.

4. Supporting rationale. Only one source or brand name is reasonably available as detailed below:
Urgency – The nature of the requirement has been deemed urgent due to unusual and compelling circumstances. Following competitive procedures would result in unacceptable delays resulting in serious injury to the Government.
A glider that was deployed five miles off the coast of Oceanside, CA, on May 30, 2024 is in distress and requires an emergency recovery. The glider’s diving behavior changed substantially on June 13, indicating that one of the sensors may be taking on water. This changes the weight distribution of the glider and prevents it from climbing to the surface after a dive. The glider is drifting approximately 140 miles offshore, which requires a vessel with long-duration range and appropriate fuel capacity. We require availability to deploy almost immediately to avoid the risk of losing the glider, or of having it drift into Mexican waters, which will complicate recovery. If we are unable to recover the glider, we lose a valuable (~$450,000) instrument and its data.
5. Market Research.
We researched several vessels for this recovery operation. Because of the distance offshore and the urgency of the requirement, only one vessel was able to meet our needs. Other vessels in the area were either booked with commercial passengers and weren’t available in a timely manner, or the distance exceeded their operational limits. Only the M/V Merlin is available this week, has the

6. Technical/Requirements Representative Certification
I certify that this requirement constitutes the Government’s minimum needs and the supporting data provided herein is accurate and complete to the best of my knowledge and belief.
