Single Source Determination Summary

This is a Single Source Determination document using Simplified Acquisition Procedures for a procurement action not exceeding the Simplified Acquisition Threshold. The Department of Commerce, NOAA Acquisition and Grants Office (AGO), Western Acquisition Division, Alaska Fisheries Science Center (AFSC), and Auke Bay Laboratories seeks to procure a liquid nitrogen generator from Rutherford & Titan Inc, located at 401 Louisiana Street, 8th Floor, Houston, TX 77002. The equipment is required to support the nutritional ecology laboratory in cryogenic homogenization of samples for fatty acids and thiaminase analysis, as well as compound specific stable isotope analysis of fish, plankton, marine mammal, and other animal tissues.

The determination justifies single-source procurement on the basis that only one source is capable of meeting the government's requirements. Rutherford & Titan is identified as the only US manufacturer of a liquid nitrogen generator meeting the exact specifications needed, including high daily performance, high output purity, low noise, small footprint, and mobility. The current liquid nitrogen generator at the facility is non-functional and requires replacement to process critical fisheries samples. The Technical/Requirements Representative, Robert Foy (Director, AFSC), certified the requirement as the government's minimum needs. The Contracting Officer (Christie Anne Lang) made the final determination on June 9, 2026, that only one source is reasonably available. Emily Fergusson, Auke Bay Labs Fisheries Research Biologist/COR, signed as a witness on May 21, 2026.
