About this file

This is a Justification for Other Than Full and Open Competition (JOTFOC) document for a succeeding lease for the Veterans Health Administration (VHA) Network Contracting Office 5. The VHA currently leases 15,592 NUSF/17,639 RSF of office and clinical space at 849 International Drive Suite 275 in Linthicum, MD for VISN 5 Headquarters, with the current lease expiring September 30, 2024.

The justification approves negotiating a 3-year succeeding lease (1 year firm, 2 years soft) with the incumbent lessor JU Airport Holding LLC without full competition, beginning October 1, 2024. The facility must be within boundaries defined by MD-170/Andover Road (South), I-695/I-97 (East), MD-295 (North), and I-195 (West). Market research conducted in February 2024 and a 15-day SAM.gov posting in May 2024 identified no other acceptable locations. The incumbent's rental rate was deemed fair and reasonable based on market comparables. The justification was approved by the VHA Lease Contracting Officer, Division Chief, and Associate Executive Director of the Office of Real Property.

JU AIRPORT HOLDING LLC (current incumbent lessor)

10. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME

ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION.

There are no systemic barriers to competition. If the agency has a continuing need for space upon lease expiration, the VHA will follow all authorities, regulations, and policies applicable to lease acquisition.

Should there be remaining useful life in the Government's tenant improvements, the Government will consider the cost of moving from the existing location, and the cost to build out new space when deciding whether to undergo a competitive action.

Additionally, objective scrutiny will be given to the customer agency's mission and security requirements (if applicable) to eliminate unnecessary agency space requirements that may be deemed unduly restrictive.

11. CONTRACTING OFFICER CERTIFICATION.

By signature on this Justification for Other than Full and Open Competition, the VA Lease Contracting Officer certifies that the award of a succeeding lease of 17,639 RSF is in the Government's best interest and that this Justification is accurate and complete to the best of the VA Lease Contracting Officer's knowledge and belief.
