FAR PART 8.405-6
Acquisition Plan Action ID: 36C242-21-AP-1456
(1) Contracting Activity: Department of Veterans Affairs, VISN 02, 561 VA New Jersey HealthCare System, 385 Tremont Ave, East Orange NJ 07018.
(2) Description of Action: This acquisition is conducted under the authority of the Multiple- Award Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501). The Pharmacy Service requires a Brand Name Only new ScriptPro Robotic Prescription Dispensing System for East Orange and upgrades to the existing ScriptPro Robots in Lyons and James J Howard CBOC in support of the COVID-19 pandemic.
Order against: FSS Contract Number: 36F797-19-D-0135
Name of Proposed Contractor: ScriptPro USA Inc Street Address: 5828 Reeds Rd City, State, Zip: Mission, KS 66202-2740 Phone: 913-403-5529
(3) Description of Supplies or Services:
COVID-19 funded VISN02 HTHC Equipment. This requirement is for a new ScriptPro central workflow management system with Pharmacy Services Portals (PSP), SP 200 robot, and associated hardware and software for East Orange VAMC; a ScriptPro central workflow management system with Pharmacy Services Portal (PSP), SP 200 robot upgrade, and other hardware, software and services for Lyons VAMC; and a ScriptPro central workflow management system with Pharmacy Services Portal (PSP), and other associated hardware, software and services for James J. Howard (Brick Outpatient Clinic).
(4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays:
FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. The ScriptPro SP200 is a robotic prescription filling system that is only available from one company (ScriptPro). ScriptPro systems have been in place at the James J Howard and Lyons campuses for over 10 years and require upgrades that only ScriptPro can do. Installation of ScriptPro systems at the East Orange campus would align all pharmacy services to the same robotic system in an effort to streamline pharmacy operations. This upgrade and addition will allow VANJHCS to deliver the same high standard of care to Veterans at all pharmacies. The ScriptPro brand robotic prescription dispensing system provides increased accountability of narcotic medications, the ability to use an automated system for hazardous drugs, the capability to utilize a mobile application and iPad for prescription pickup, the ability to send text messages for prescriptions status/shipment notifications, and the capability to utilize the automated kiosk check-in system. This technology will also aid COVID-19 efforts as it has a texting option and a wireless iPad signature option that will allow for curbside delivery and keep patients out of the hospital waiting areas.

VHAPM Part 808.405-6 Limiting Sources Original Date: 08/30/2017 Revision 03 Eff Date: 03/18/2021
ScriptPro’s perpetual inventory system (SIMS) has also been selected by VACO as the national perpetual inventory system.
FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.
FAR 8.405-6(b): Items peculiar to one manufacturer:
A patent, copyright or proprietary data limits competition. The proprietary data is:
These are “direct replacements” parts/components for existing equipment.
The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing.
(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination. Standardization of ScriptPro systems within the VANJHCS represents the most cost-effective and efficient method of dispensing medications, as well as tracking and reporting medication usage. New investments in competing systems are not in the Government’s best interests due to potential compatibility issues and non-compliance with VACO direction regarding perpetual inventory management systems. Further, in accordance with FAR Part 8.404(d), FSS pricing has already been determined to be fair and reasonable. I hereby determine that the proposed contract action will represent the best value to the government. Also, the CO will seek additional discounts from ScriptPro in accordance with FAR Part 8.405-4 as this action exceeds the SAT.
(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted. Market research identified competing brands offering a range of capabilities but current system upgrades must be performed by the OEM and the new system for East Orange is to be standardized to the ScriptPro brand as well.
(7) Any Other Facts Supporting the Justification: This purchase will allow the VA New Jersey Pharmacy department to provide safe, efficient, consistent care to our Veterans. There are many benefits to be gained with this purchase including the increased accountability of narcotic medications and the ability to use the automation system for hazardous drugs. (This was previously impossible due to cross contamination risks). Also, Pharmacy will be able to utilize a mobile app and iPads for prescription pickup which will help reduce foot traffic within the medical center via curbside pickup. This provides the capability to send text messages for prescriptions status/shipment notifications. The system will also potentially reduce staffing requirements by 2 FTEs as triage will utilize the automated kiosk check in system. This technology will also aid COVID-19 efforts as it will help allow for curbside delivery and keep patients out of the hospital waiting areas.
(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made. The implications of not making a sole source brand name purchase at this time would create a hardship to VANJHCS not only for Pharmacy operations on three campuses but to the care of our Veterans at all of our pharmacies.
