About this file
This is a Justification for Limiting Sources (LSJ) document for a Federal Supply Schedule (FSS) order under the Department of Veterans Affairs' micro-purchase threshold procedures.
The Department of Veterans Affairs, Network/Program Contracting Office 16 (located in New Orleans, Louisiana) is procuring maintenance and support services for two GeneXpert diagnostic laboratory units (Model XVI, Serial No. 812139 and Model Infinity, Serial No. 810073) located at the Southeast Louisiana VA Health Care System's Pathology and Laboratory department. The contract covers a twelve-month base period plus three one-year option periods for a total estimated value of $299,516.00. Services include software maintenance, application usage, system updates, system enhancement, database management, backup and recovery, and 24-hour support. The order will be placed against FSS Contract Number GS-07F-0597T with proposed contractor Cepheid (904 E Caribbean Drive, Sunnyvale, California 98089; phone: 888-838-3222).
The contracting officer, Rachel Babin, justified limiting the source to Cepheid as the sole provider under FAR 8.405-6(a)(1)(i)(B), establishing that only one source is capable of providing the required supplies or services at the necessary quality level because the services are unique or highly specialized. The justification emphasizes that Cepheid is the original equipment manufacturer (OEM) and the only entity capable of accurately calibrating and verifying the equipment. Incorrect calibrations could result in misdiagnosis of veterans, posing significant patient safety risks. The determination was signed and dated April 15, 2026, with Acquisition Plan Action ID 36C256-26-AP-3132.

16, located at 1515 Poydras Street, NOLA 70112, in support of VISN 16 Southeast Louisiana VA Health Care System at 2400 Canal Street, NOLA 70119 2237:629-26-3-036-0729
2. Description of Action: This is to cover the below equipment for the period of twelve (12) months plus three (3) option years for the total contract price $299,516.00.
Model Serial Number MX Number GeneXpert XVI 812139 435721
GeneXpert Infinity 810073 435709
Order against: FSS Contract Number: GS-07F-0597T
Name of Proposed Contractor: Cepheid Street Address: 904 E Caribbean Drive City, State, Zip: Sunnyvale, CA 98089 Phone: 888-838-3222
3. Description of Supplies or Services: The proposed service agreement/contract would cover all necessary software, application usage maintenance, updates, system enhancement, database management, backup and recovery, and 24-hour.
The estimated value of the proposed action is $299,516.00.
The GeneXpert equipment located in the Southeast Louisiana Veterans Healthcare System’s Pathology and Laboratory department are vital to the processes within SLVHCS. These units are used currently to test for COVID-19 and need to be calibrated and verified annually to allow the technicians to accurately read the equipment. The manufacturers at Cepheid corporations are the only ones that can accurately determine the calibration. If the calibrations are incorrect, the result could lead to a misdiagnosis of a veteran that could potentially cause great harm to the veteran. To prevent this from occurring, Cepheid would need to be the main contractor to come and support the pieces of equipment.

4. Authority:
Order Against FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:
An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);
Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;
(FAR 8.405-6(a)(1)(i)(B));
In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405- 6(a)(1)(i)(C)); or
Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).
5. Rationale/explanation to support cited authority:
Cepheid corporation is the OEM and the only source that can accurately determine the calibration. If the calibrations are incorrect, the result could lead to a misdiagnosis of a veteran that could potentially cause great harm. Orders can be written against FSS schedule GS-07F-0597T due to this being a sole source service to the large business Cepheid.
6. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
