About this file

This is a Justification for Limiting Sources (LSJ) document for a Federal Supply Schedule (FSS) micro-purchase action by the Department of Veterans Affairs.

The Department of Veterans Affairs, Network/Program Contracting Office 02 in Albany, New York, is requesting the purchase of Mynd Immersive (Clinic Version), a clinical virtual reality therapy system, for the Buffalo VA Medical Center. The requirement includes hardware, therapeutic software content, clinical configuration, staff training resources, and operational integration materials to support treatment for chronic pain, anxiety, stress, and insomnia under the VA's Pain Management, Opioid Safety, and Prescription Drug Monitoring Program (PMOP). The proposed contractor is USVETSERV, LLC, located in Simpsonville, South Carolina (877-409-8787), and the order will be placed against FSS Contract Number 47QSWA22D0012. The document justifies limiting the source based on two grounds: (1) only one source is capable of providing the supplies at the required quality level because the supplies are unique or highly specialized, and (2) items are peculiar to one manufacturer. The rationale explains that Mynd Immersive is the only VR therapeutic system formally integrated into the VA's PMOP prescription model and the only VR platform approved for direct home deployment to veterans in rural areas. Additionally, the system is the only VR solution designed to comply with VA telehealth, security, and privacy requirements and is fully embedded across the VA's national immersive rollout. The estimated contract value exceeds $25,000, and the documentation will be posted on e-Buy as required. The contracting officer is Myra F. Green, NCO 2, with a signature date of August 25, 2026.

2002 (PL 107-107) and implemented by RFO FAR 8.401(b) IAW GSAR 538.7104-3(a). Mark the applicable exception:

An urgent and compelling need exists, and following the procedures would result in unacceptable delays;

Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures; or

Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.

Rationale/explanation to support cited authority: Mynd Immersive is the only VR therapeutic system formally integrated into the VA’s PMOP prescription model, enabling clinicians to issue standardized non-drug VR therapy recommendations. It is also the only VR platform approved for direct home deployment to veterans, including those in rural areas, meeting VA’s strict dispensing protocols. The system is uniquely designed to comply with VA telehealth, security, and privacy requirements by operating without automatic data streaming, unlike other VR solutions. Additionally, Mynd Immersive is fully embedded across the VA’s national immersive rollout—used at multiple VA sites and supported by VA-standard templates, workflows, training materials, and sanitization procedures—meaning no alternative VR product can be substituted without disrupting established national infrastructure and requiring extensive retraining and redevelopment.

BRAND NAME ONLY: This buy is estimated to exceed $25,000 and this documentation will be posted along with the RFQ on e-Buy, as required by FAR 8.40

Note that this determination satisfies the requirements of RFO FAR 8.401 The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
