About this file

This document is a Limiting Sources Justification (LSJ) for a sole source procurement of microbiology supplies for the Department of Veterans Affairs (VA) Veterans Integrated Service Network (VISN) 1 from Cardinal Healthcare. The VA intends to award a 5-year firm-fixed price Blanket Purchase Agreement (BPA) for these supplies without competition. The justification outlines the need for the sole source arrangement due to Cardinal Healthcare's status as the incumbent supplier and the agency's requirement for compatibility with their existing microbiology equipment and processes. The VA is posting this notice to provide an opportunity for other vendors to demonstrate their ability to meet the requirements, but the final decision to compete the procurement is at the government's discretion. Vendors have until October 25, 2024 to submit information demonstrating their capabilities. Any vendor response will be evaluated, but the VA may still proceed with the sole source award to Cardinal Healthcare if no acceptable alternatives are identified.

DEPARTMENT OF VETERANS AFFAIRS

FAR 8 – Justification for Limiting Sources (LSJ) For

Limiting Sources (<SAT)

Acquisition Plan Action ID: 36C241-25-AP-0263

1. Contracting Activity: Department of Veterans Affairs, Regional Procurement Office East, Network Contracting Officer 1 (New England) on behalf of VISN 1 Network Consolidated Laboratory (NCL).

2. Description of Action: New five year requirement for microbiology supplies

Name of Proposed Contractor: Cardinal Healthcare Street Address: 3651 Birchwood Dr.

City, State, Zip: Waukegan, IL 60085 Phone: 1-800-444-1166, fax 1-800-417-1079

3. Description of Supplies or Services:

The estimated value of the proposed action is $ 165,000.00

The purchase of Microbiology media and supplies are required for patient care in the VISN 1 Microbiology Labs. There are over 150 microbiology media supplies that need to be purchased throughout the fiscal year. Many of these items have an extremely short shelf life and need to be ordered repeatedly during the year. Cardinal Health and VA Boston have created a simplified ordering process for these items and most of their items have been significantly discounted.

The ordering process is done off a master template which the Microbiology Director/Supervisor in Boston just notates the product and quantity needed. This saves a lot of time that can be dedicated to patient care instead of administrative duties.

Cardinal Health has proven to be extremely reliable at having all of these items on hand which is critical to patient care. Their past performance has been exemplary. Other VISN 1 sites order as well using a VA purchase cards as needed.

ORDER AGAINST FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:

An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);

Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

(FAR 8.405-6(a)(1)(i)(B));

In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405- 6(a)(1)(i)(C)); or

Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).

5. Rational/explanation to support cited authority:

These Microbiology media items are not available by any known distributors, only by the OEM Cardinal Health. Even though a media can have the same name from 2 manufacturers, there are subtle differences in these which can lead to bacteria cultures expressing different colors and growth. The media supplied by Cardinal has been used in the VISN for many years and staff have become proficient at interpreting the bacteria by this same media.

Changing to a different media would require lengthy and costly validation studies, retraining of staff and could change a technologists interpretations ultimately affecting patient care.

These supplies are highly specialized and specific to the work. It makes the process much smoother than the process of calling customer service and being on the phone for an extended amount of time.

6. BRAND NAME ONLY: This buy is estimated to exceed $25,000 and this documentation will be posted along with the RFQ on e-Buy, as required by FAR 8.405-1(e).

7. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
