CUI//SP-PROCURE
Control No: JA-23-Hua-
Memorandum for Record – Limiting Competition at or below the Simplified Acquisition Threshold
1. Contracting Activity: U.S. Army Contracting Command
Aberdeen Proving Ground (ACC-APG), Huachuca Division
ATTN: CCAP-CCH
2133 Cushing Street, Building 61801 Fort Huachuca, AZ. 85613-7070
2. Description of Action: This Brand Name Justification has been prepared to procure WARDjet A-1212 waterjet in support of the United States Army Electronic Proving Ground (USAEPG), Fort Huachuca, Arizona. The anticipated types of funds are Fiscal Year (FY) 23 Research, Development, Test and Evaluation (RDT&E) funds. This resultant contract will be a Firm-Fixed Price.
3. Description of Services or Supplies: USAEPG requires the procurement of WARDjet A-1212. WARDjet A-1212 waterjet is a small compact machine that allows for a 4-foot by 4-foot piece of stock to be used while maintaining a small overall footprint.
The advantages of a waterjet allow for cutting of flat stock in a very timely manner that increased the capabilities of the T2D2 laboratory, which is required for the ever-changing requirements of the mission. The current machines used are not as large as required by many of the tests. The laboratory has had to turn away work for test due to lack of infrastructure to support their requirements.
With a water jet, drainage is required to function fully. The WARDjet company worked to provide a solution as the T2D2 area is not equipped with a drainage system. The solution is a filter that changes the discharge into gray water that then can be drained into a 55-gal drum and properly disposed of.
Delivery Date: 12 weeks ADC
4. Authority: FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
5. Reasons for Authority Cited:
a. Due to the safety concerns of a water jet, a fully enclosed unit is required to protect the operator. This option is only available from two (2) companies. Out of the two machines available, the WARDjet has the largest working footprint, having a 4 ft x 4ft space compared to 4 ft x 2 ft. It also goes a step further to provide safety from noise by introducing submersible cutting.
b. During market research, it was found that fully enclosed waterjets that are in a size that can be supported in the lab were very few, two (2) companies make such items. The WARDjet is the larger of the two and provides the best support for the tasks projected for the lab. As WARDjet is the manufacturer, the A-1212 can only be bought through them.
There are no authorized dealers or competitors that sell a completely identical item.
c. The advantages of a waterjet allow for cutting of flat stock in a very timely manner that increased the capabilities of the T2D2 lab, which is required for the ever-changing requirements of the mission. The current machines used are not as large as required by many of the tests. The lab has had to turn away work for test due to lack of infrastructure to support their requirements, which can cause delays.
6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 apply and will be followed. It will be redacted and posted with the solicitation.
7. Market Research: Due to the safety concerns of a water jet, a fully enclosed unit is required to protect the operator. This is where research started as this requirement is the highest priority. Due to this restriction, only two (2) companies were found: WARDjet A- 1212 and Flow NanoJet. The NanoJet is an overall bigger machine with a smaller cutting area. Both companies were contacted. WARDjet contacted back and worked to provide all the necessary information on their product and work through some problems that arose with introducing a waterjet, (including sending out a representative to discuss how the product will fit in our lab).

The solution is a filter that changes the discharge into gray water that then can be drained into a 55-gal drum and properly disposed of.
8. Other Facts: By procuring a waterjet, the T2D2 lab increases the capabilities to support the mission, due to restrictions for safety of the lab personnel. Only one machine provided all that is required, and this item is not made or supported by any other company.
