Memorandum for Record – Limiting Competition at or below the Simplified
Acquisition Threshold
1. Contracting Activity: Army Contracting Command Redstone Arsenal Corpus Christi Army Depot (CCAD), Contracting Office (CCAM-ALC) 9035 Ocean Dr. Bldg. 10, Mail Stop 18 Corpus Christi, TX 78419-5260.
2. Description of Action: Engine test cell repairs.

3. Description of Services or Supplies: This action is for the procurement of engine test cell repairs to include replacement of Foxboro Switches. The repairs will be made to Engine Test Cell 05 (ETC05), Bar Code Z8210, and Engine Test Cell 10 (ETC10), Bar Code Z8213. The repairs will consist of complete replacement of the existing Foxboro Switches along with installation and configuration services required to demonstrate equivalent functionality. Period of performance will be two (2) months. No options will be included. Total estimated value of the proposed action is
4. Authority: FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
5. Reasons for Authority Cited: The Corpus Christi Army Depot (CCAD) has a requirement for engine test cell repairs for the equipment referenced above in paragraph 3. The Foxboro Switches were procured from the Original Equipment Manufacturer (OEM), Schneider Electric Smart Grid Solutions, LLC. The OEM is has all proprietary rights of their designs, drawings, and specifications required for their equipment. As a result, there are no other known sources capable of performing the required repairs.
The engine test cells are critical equipment. The equipment is currently inoperable.
Without the necessary repairs, CCAD will not be able to complete the mission which is detrimental to the depot causing significant production delay. CCAD does not have the expertise or the qualified personnel to perform the repairs required for the equipment.
6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203, apply and will be followed.
7. Market Research: In accordance with FAR Part 10, market research has been conducted for this action by Joel Valdez, Equipment Specialist and Jennifer Salyers, Contract Specialist.
Contact with knowledgeable persons in Government and/or industry regarding the commercial nature of this requirement and/or standard industry practices in this area of supply/services.
Mr. Valdez contacted:
Terry Beck, Mechanical Engineer (27 APR 2023 to present) - discussions were held with the Industrial Automation Branch Chief, Brad Burks (04/27), and the Foxboro Sales Account Representative, Edwin Velazquez (04/28), to determine if in-house expertise and commercial equivalent equipment could be substituted for the particular Foxboro parts and configuration that have met life-cycle, and the conclusion was that neither would be an acceptable solution.
Ms. Salyers, Contract Specialist reviewed Government and commercial databases for relevant information.
The Foxboro switches are sold in the commercial marketplace based on market research conducted by performing a Google search and found Scheider Electric Smart Grid Solutions, LLC. Company’s website. In addition, the company’s website list many services offered commercially.

I certify that this justification is accurate and complete to the best of my knowledge and belief, and that completing this purchase as a sole source is in the best interest of the Government. Additionally, I approve this justification to limit competition subject to the availability of funds and provided that the services or supplies herein described have otherwise been authorized for acquisition.
