☒ FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold
(SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
5. Reasons for Authority Cited:
The Government has a continuing need to provide follow-on to W81K00-20-F-0227 Radiopharmaceuticals as needed during FY22. Radiopharmaceuticals are required by GLWACH Nuclear Medicine Department for cardiological, oncological, neurological and general nuclear medical assessment, diagnosis and treatment of patients.
Radiopharmaceuticals are precise and must be matched to the actual procedure and for the specific patient requirements.
There are eight established BPAs for radiopharmaceuticals that were competed on the open market as full and open competition. These eight BPAs are available for use by MTFs within the Regional Health Command-Central's (RHC-C) area of responsibility.
Although there are eight available BPA’s, is currently the only vendor of the multi award BPA’s that offers and can meet GLWACH’s requirements of providing and delivering the required radiopharmaceuticals that can currently meet the unit of measure and specific calibrations that are required by the Department of Nuclear Medicine. , is able to provide and deliver the radiopharmaceuticals because they are the closest company to the GLWACH area and can provide the required radioactive materials in a timely fashion. The radiopharmaceuticals that are used have a short time of usage due to the radioactive decay factor. These products are ordered daily for the next day’s patients. The department cannot stock pile these products due to the decay factor of the radioactive element.
GLWACH’S Nuclear Medicine Service selects and orders a particular required radiopharmaceutical based on specific treatment need in combination with timely availability for which radiopharmaceutical pharmacy, in certain cases, is the only source which can meet a specific requirement. Without these products the Nuclear Medicine department would be non-operational and the mission and patient care would fail.
6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 ☒ apply and will be followed.
☒Action is a brand name restriction, over $25K. It will be redacted and posted with the solicitation.
7. Market Research: Initial market research revealed that the suggested vendor, a large business, was the only company that could provide all of the products that are needed for this requirement. Although the competed requirement produced the multiple award BPA’s for radiopharmaceuticals the other companies currently cannot provide the specific unit of measure and the required calibrations requested by GLWACH and currently can only be fulfilled by . The BPA’s are a result of a competitive action and solicitation.
8. Other Facts: The current multiple award suite of radiopharmaceutical BPAs were a result of competitive solicitation and award. It is anticipated as the suite of BPAs expire
(30 September 2025) the follow-on solicitation of BPAs will be similarly competitive. A Special Notice of Intent for the proposed limited source award will be posted on Government Point of Entry beta.SAM.gov for which any responsible sources may submit a capability statements, proposals, or quotations which shall be considered by the agency for future requirements. When the current requirement reaches the end of its time frame, becomes obsolete or when equivalent appropriate radiopharmaceuticals become available every effort shall be made to increase competition and therefore an evaluation shall also be made concerning pertinent services. GLWACH in conjunction with MEDCOM will continue to evaluate the capabilities of other vendor's services in order to provide items that are of the best value to the Government. The Government will continue to seek new resources that will satisfy these requirements through continued market research, requests for Statements of Capability, and telephonic inquiries. For future actions, the Government will reassess the market for available vendors, including but not limited to, issuing a Sources Sought Notice to determine market availability for brand name, or equal requirements.
