LIMITED-SOURCES JUSTIFICATION
In accordance with the requirements of FAR 8.405-6, the justification for awarding a delivery order without competition under the General Services Administration Federal Supply Schedule (GSA FSS) is as follows:
(1) Identification of the agency and the contracting activity
The Division of Administration (DA), Business Operations Branch (BOB) of the Commodity Futures Trading Commission (CFTC).
(2) Nature and/or description of the action being approved.
The CFTC seeks to award a GSA FSS delivery order to upgrade the current Human Resources (HR) Monster Government Solutions (MGS), LLC’s Onboarding module to onboard government and contractor employees, collect and render customized forms, integrate with the CFTC’s existing personnel clearance system (PCS) and provide notifications and access to applicable offices (e.g., Security, General Counsel, Logistics…).
(3) A description of the supplies or services required to meet the agency’s needs (including the estimated value).
The CFTC has a requirement to upgrade the MGS Onboarding module to support new CFTC FTE hires and contractor onboarding. The upgrade to the Onboarding module is to provide CFTC Human Resources (HR) Branch with: an automated workflow to support the onboarding process; the ability to send job offer letters, forms and other documents to the new hire; allow the selected candidate to complete and return forms to HR and security; and, allow for the ability to standardize and manage letter templates, email notifications and form packages for each type of hire in the system library.
Prior to final acceptance and deployment by the CFTC, the upgrade shall be FedRAMP certified.
The estimated value of the eight-month effort is
(4) The authority and supporting rationale (see 8.405-6(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
In accordance with FAR 8.405-6(a)(1)(C), “In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures.”.
FOR OFFICIAL USE ONLY
The CFTC currently uses the Monster Government Solutions, LLC’s HR Suite. The licenses were recently renewed and has options that go through September 30, 2025. The selected vendor is required to have the authority and ability to access the MGS, LLC proprietary information to perform the Onboarding Module upgrades. MGS, LLC does not have resellers authorized to perform the upgrade requirement and therefore, the effort is limited to MGS, LLC to perform the upgrade.
(5) A determination by the ordering activity contracting officer that the order represents the best value consistent with 8.404(d).
The contracting officer has determined that the independent government cost estimate is fair and reasonable based on market research, available hourly pricing for the Monster Onboarding module upgrade on GSA IT-70 Schedule and the technical assessment that the hours to perform the work are based on historical efforts and parametric analysis for support labor categories. The projected hourly rates will be reviewed and shall not exceed those listed under the GSA Schedule contract.
Furthermore, the CFTC has determined that procuring the upgrade to the existing CFTC Monster Onboarding Module will represent the best value to the Government and will result in the lowest overall cost alternative to converting to a different manufacture’s HR Suite solution. Using another manufacture’s product(s) would require taking critical systems offline for an unknown duration and any cost savings to implement another manufacture’s product would more than offset any savings obtained through a competitive procurement that would consider other solutions.
(6) A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
As described in the below, the primary requirements for upgrading the Monster Onboarding Module are as follows:
The upgrade requires the vendor to have access to proprietary data and authority to perform the efforts to upgrade the Onboarding Module;
The upgraded Onboarding module is required to be compatible with the current CFTC HR Suite infrastructure;
The product is required to be able to efficiently utilize existing HR Suite processing resources; and
The upgraded Onboarding module will be required to interface with the Department of Agriculture, National Finance Center (NFC) EmpowHR solution in the future.
The CFTC technical staff did not perform any formal market research as the MGS onboarding module is built into the existing HR Suite. The technical analysis was that the use of any other manufacturer’s onboarding module would require a major modification to the existing CFTC HR Suite infrastructure as well as integrate with the other components of the MGS HR Suite.
(7) Any other facts supporting the justification.
None.
(8) A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.
The agency intends to solicit this requirement from Monster Government Solutions, LLC for the reasons stated in 4 and 6 above. In the event of a re-design and full HR Suite replacement, the CFTC would consider all viable options, including items from other manufacturers. However, CFTC’s current infrastructure configuration includes the Monster HR Suite. As a result, the solicitation will be limited to Monster Government Solutions, LLC to provide and support the Onboarding module upgrade.
(9) Evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government’s minimum needs or requirements or other rationale for limited sources) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel.
Technical Personnel Certification In accordance with FAR 8.405-6(c)(2)(x), I certify that the data supporting the recommendation to solicit and award on a brand-name basis is accurate and complete to the best of my knowledge and belief.
Commodity Futures Trading Commission
(10) Contracting Officer’s Certification
In accordance with FAR 8.405-6(c)(2)(ix), I certify that the data supporting the recommendation to solicit and award on a limited sources basis is accurate and complete to the best of my knowledge and belief, applies to this action.
