The statutory authority, which permits restricting consideration of schedule contractors to fewer than that required in FAR 8.405-1 (Ordering procedures for supplies and services not requiring a statement of work).

The justification for limiting sources is pursuant to FAR 8.405-6(b)(1) – The item is peculiar to one manufacturer. Purchasing the required Recorded Future Enterprise licenses is beneficial to the Navy because Recorded Future does directly support warfighter operations or other NAVIFOR authorized

Fleet or cyberspace operations, based on the in-depth information that Recorded Future will provide

NCDOC Analysts the ability to be more proactive in their network defense mission instead of reactive.

It provides relevance and context far beyond the general threat feeds, increasing the effectiveness of our

Situational Awareness tools and countermeasure capabilities. The intelligence garnered from this tool will allow the entire Navy to be defended by rapidly deploying countermeasures to our Capabilities vice cleaning up after a Cyber Incident. This will empower the analytical elements of the DCO Task Force to guide decision makers and operators to make better-informed decisions as far left in the kill chain as possible.

The Analytics Platform includes cyber intelligence analytics, alerting, advanced query capabilities, visualizations, collaboration capabilities, and reports. Recorded Future Enterprise encompasses the full range of capabilities required by NCDOC, and is the only product known to satisfactorily provide the necessary services. Recorded Future Enterprise software is currently in use in the NCDOC infrastructure. NCDOC would have to purchase multiple software packages to obtain a full range of required capabilities and re-engineer the entire network, which would cost an estimated and take approximately 12 months to implement. This would significantly impact NCDOC’s mission and require a complete network shutdown.

5. Determination of the Best Value. GSA has determined the prices of supplies of the schedule contracts to be fair and reasonable for the purpose of establishing the schedule contract. Therefore, ordering activities are responsible to make a separate determination of fair and reasonable pricing for individual orders, BPAs, and orders under BPAs. The Fleet Logistics Center Norfolk Contracting

Officer will determine, using the procedures in FAR 13.106-3, that the order prices are fair and reasonable and will document such determination with a level of detail commensurate with the complexity and circumstances of each order.

6. Description of market research among schedule holders and the results or a statement of the reason market research was not conducted.

The requiring activity and contracting activity have conducted market research to determine capable sources to meet the Government’s minimum requirement and among Recorded Future authorized reseller’s schedules. Market Research conducted reviewed the mandatory sources for commercial software and related services in accordance with DFARS 208.74, Enterprise Software Agreements, that is applicable for software that is acquired under a FSS contract or BPA established in accordance with FAR 8.405. DFARS 208.7402(1) states that "agencies shall fulfill requirements for commercial software and related services, such as software maintenance, in accordance with the

DoD Enterprise Software Initiative (ESI)". Market Research revealed that the required Recorded

Future software is available through a DOD Enterprise Software Initiative.

BPA with Carahsoft Technologies under BPA N66001-19-A-0120. In accordance with

DFARS PGI 208.7403(3), the contracting officer reviewed the terms and conditions and prices of the BPA. DoD is a mandatory source, this requirement must be met by issuing a call against the ESI BPA holder. As such, FLCN intends to procure the required brand-name software licenses through ESI BPA N6601-19-A-0120. The contracting officer has determined the ESA represents the best value to the Government, and as such, the contracting officer is required to fulfill the requirement for the software through the ESA as it is a mandatory source in accordance with DFARS PGI 208.

7403(3).

7. Any other facts supporting the justification. This procurement uses a GSA Schedule and will be solicited and awarded in accordance with FAR Subpart 8.4.

8. Actions the Agency may take to remove or overcome barriers to competition.

As stated in paragraph four (4) the required supply is brand specific and is only available from the manufacturers authorized distributors. Future requirements for the same supply would be competed amongst the manufacturer’s authorized distributors. If another potential source emerges, the Government will assess whether competition for future requirements is feasible. All future requirements will be researched on a case-by-case basis.

9. Contracting Point of contact.
