LIMITED SOURCE JUSTIFICATION
FAR Part 8.4 - Federal Supply Schedule
1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY
Contracting Activity Department of Labor
OASAM/OSPE
200 Constitution Ave. NW Washington, DC, 20210
Customer Agency Department of Labor
BLS/OTSP
2 Massachusetts Ave. NE Washington, DC 20212
2. NATURE AND DESRIPTION OF THE ACTION BEING APPROVED:
The Department of Labor (DOL), Office of the Assistant Secretary for Administration and Management (OASAM), Office of the Senior Procurement Executive (OSPE) proposes to modify Blanket Purchase Agreement (BPA) Call 1625DC-19-F-0071 (Task Order 5) to add a new task pursuant to FAR 8.405-6(a), Limiting Sources.
3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET
THE AGENCY’S NEEDS (Including the Estimated Value):
DOL intends to limit the number of sources solicited pursuant to FAR 8.405-6(a) to modify Task Order 5 to add Task 5 – Survey of Occupational Injuries and Illnesses (SOII) Integration Development, Modernization and Enhancement (DME). Task Order 5 was awarded to INDUS Secure Network Solutions, LLC to provide Information Technology support services for Application Development Support for the BLS Office of Compensation and Working Conditions (OCWC). The scope of Task Order 5 includes performing the following IT services: Application Development, Database Design and Management, Requirement Analysis, Software Design, Testing, Documentation, and Production Support and Maintenance. The estimated value of the new Task 5 is $ . With this modification, the total estimated value of the task order (including options) is $ .
4. IDENTIFICATION OF THE AUTHORITY AND RATIONALE:
The authority of this request is FAR 8.405-6(a)(1)(i)(C) - In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures; the original task order was competitively solicited and awarded using the ordering procedures at FAR 8.405.
The work that is being added under Task 5 covers the development of a new web-based system that will integrate all SOII processes: Sampling, Data Collection, Estimation, and Data Dissemination. Currently these four phases are conducted in separate systems: SOII Universe Refinement Process Allocation Sampling System (SURPASS), SOII Survey System (S3Web), and Case and Demographics System (C&D). The SOII Integration project will modernize and integrate these separate SOII systems into one cohesive, Web-based system. While there are several objectives for the SOII Integration development project, the main objective is to replace two legacy estimation systems with modernized technology to avoid web browser compatibility issues. One of the estimation systems has been in production for approximately 23 years and the other for approximately 17 years. Another main objective is to introduce a new estimation product for SOII-multiyear estimates. The Agile Scrum Software Development Methodology will be used to develop the new SOII integrated system.
The work described above is directly tied to and a natural follow-on to work that is already being performed on the Task Order, specifically under Task 2 – Maintain OCWC Web-based Applications (Maintenance). Current support provided under Task 2 includes the maintenance of the same systems (SURPASS, S3Web, and C&D) that will be modernized and integrated into one system as part of this new SOII Integration project under Task 5. Thus, work on these systems is already being performed, and the integration of these separate web-based systems into one cohesive web-based system is a logical follow-on to the work already being performed under Task 2 of the current task order.
As a result of INDUS’s intimate knowledge of the nature of this work and the SOII systems that will be under development, it is necessary to limit competition for the new work described herein as a logical follow-on. INDUS is the only vendor suited to provide this support at this time. If a different vendor were to come in and try to perform this work, it would take more time and more money for them to get up to speed, to understand the project, and to perform the necessary work.
These legacy systems have numerous operational issues given their age, and making changes to the existing systems is both time and labor intensive. Therefore, it is critical to have INDUS’s expertise in order to successfully develop this new Web-based system to integrate all SOII processes. If the additional work is not added to this task order and a vendor that is unfamiliar with the systems and all of their nuances is contracted to do the work, BLS is at risk of prolonging the use of these outdated systems which could lead to publishing incorrect data. Thus, in the interest of both economy and efficiency, it is in the best interest of the Government to add this work to the existing Task Order and have INDUS continue to perform the tasks outlined in the Performance Work Statement.
5. DETERMINATION BY THE ORDERING ACTIVITY THAT THE ORDER
REPRESENTS THE BEST VALUE FAR 8.404(d):
The Contracting Officer has determined that issuing the proposed modification to INDUS to add Task 5 represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs. The BPA and resultant task order were placed in accordance with FAR 8.404, “Use of Federal Supply Schedules.” The General Services Administration (GSA) has already negotiated fair and reasonable pricing rates. INDUS provided further discounts to these GSA schedule rates for the BPA. To determine that the total price is reasonable, the contracting activity will verify that the proposed rates are in accordance with INDUS’s current BPA rates, and the ordering activity will consider the level of effort and the mix of labor proposed to perform the specific task being added.
6. A DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE
RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS
NOT CONDUCTED:
Since the proposed new work is directly related to the current task order work and the task order period of performance ends in six months, market research was not conducted at this time.
7. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION:
None.
8. A STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE
ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS
MADE:
Task Order 5 is a one-year task order with a period of performance that will expire on February 7, 2021. This work will be re-competed among the Application Development BPA holders within the next six months to establish a new five-year task order.
