LIMITED SOURCES JUSTIFICATION ORDER >SAT

FAR PART 8.405-6

Acquisition Plan Action ID: 36C260-20-AP-4332

(1) Contracting Activity: Department of Veterans Affairs, Regional Procurement Office West, Network Contracting Office 20 on behalf of VISN 20 sites Boise, Portland, Puget Sound, Spokane and White City Medical Centers. 2237# 101-20-4-6010-0165

(2) Description of Action: This acquisition is conducted under the authority of the Multiple Award Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501 ). As part of the VA Electronic Health Record Modernization (EHRM) Cerner initiative, this procurement is for upgrade to all Natus Electroencephalography (EEG) and Electromyography (EMG) equipment, an interface of Natus EEG and EMG equipment to the new Electronic Health Records (EHR), Cerner, and system testing.

Order against:FSS Contract Number: 36F79718D0330 Name of Proposed Contractor:Natus Medical Incorporated
Street Address:6701 Koll Center Pkwy Suite 120

City, State, Zip: Pleasanton, CA 94566-8061

Phone:

(3) Description of Supplies or Services:

The estimated value of the proposed action is $326,943.28

VISN 20 is actively implementing the Cerner EHRM system and must ensure all technology in use at all facilities is compatible. All locations listed below have Natus EEG and EMG equipment and software currently installed, and this requirement is to provide upgrades to that equipment and software and create an interface program to connect the EEG and EMG software with Cerner.

Boise currently has 1 EMG unit. This order would upgrade that unit and provide them with a 2nd unit. The 2nd unit supports an expanding demand, fits into an existing capability and maintains the same functionality . Spokane is upgrading 1 EMG + workstation and 1 EEG unit, Seattle is upgrading 1 EMG and 1 EEG+ workstation, and White City is upgrading 1 EMG unit. Since Portland has been upgrading its EEG equipment over the years, they only require the EEG HL7 Implementation for the licensing and configuration to be able to connect the Natus EEG system to Cerner. This procurement will bring all VISN 20 Natus EEG and EMG equipment to the same level and allow connection to Cerner.

(4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service.

FAR 8.405-G(b): Items peculiar to one manufacturer:

The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing.

VISN 20 sites do not currently have the optional functionality of interfacing with the VistA EMR. It is a requirement for Cerner Capability Set 2 (CS2) for Natus EEG and EMG equipment to be able to receive orders from Cerner and send results back to Cerner to add this functionality.

Implementation for this includes ensuring that each site has compatible and sufficient hardware and software to meet the requirements for transitioning to Cerner.

(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination:

The Natus EEG and EMG monitoring equipment and software are currently being used in these VISN 20 sites. A change from this monitoring system in order to integrate with Cerner would require replacing all existing monitoring carts, servers and infrastructure (such as in Portland's multiple seizure labs) which would yield a significantly higher cost . There would also be a significant increase in cost and the time and effort required to develop an integration due to the requirements of purchasing entirely new systems. This could place the Cerner transition timelines at risk.

The Contracting Officer has determined that the anticipated cost to the government will be fair and reasonable. The NAC competed the overarching FSS contract, therefore competition and subsequent award presumes best value at a fair and reasonable cost.

(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted.

The Government's technical experts conducted market research by reviewing other similar software and monitoring systems. Natus is the current leader in the field of EEG monitoring equipment for routine and long-term studies. Portland will be receiving required upgrades for EEG . Natus EMG Viking/ Synergy EMG equipment has been deemed clinically preferred for Puget Sound, Boise, Spokane, and White City VA facilities.

Pursuant to FAR Part 10, the Manufacturer, Natus, was contacted for a list of SDVOSB/VOSB approved distributors and was informed they do not use distributors or subcontractors to meet our requirements due to the proprietary nature of their NeuroWorks/SleepWorks and Viking/Synergy EMG software and equipment .

(7) Any Other Facts Supporting the Justification:

With the timing of the required interface with Cerner and the fact that the EEG and EMG software is already in use in VISN 20, the justification for other than full and open competition is supported. Because Natus doesn't have approved distributors/subcontractors, Natus is the only source capable of developing an interface between this EEG/EMG equipment and Cerner, which is also a requirement of this procurement .

(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made:

If the VISN or facility determines that a new system is required, then the market will be surveyed to determine if there are any other sources who could fulfill the requirement.

(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fi de Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
