About this file

This document is a Limited Source Justification for a Federal contract opportunity under FAR Part 13 Simplified Acquisition Procedures. The procurement is for various musical instruments, equipment, and accessories to replace items that are no longer operational or beyond their service life for the 248th Army Band. The contracting officer is justifying the use of brand name specifications, as the equipment must be compatible with the band's existing inventory and meet the performance requirements for Army music units. The total estimated value of the procurement is not provided.

The Federal contract opportunity is a Request for Quote (RFQ) for the procurement of the musical instruments and equipment for the 248th Army Band. It is a 100% Small Business Set-Aside acquisition with a NAICS code of 459140 - Musical Instrument and Supplies Retailers. The Government intends to award a single firm-fixed price contract resulting from the RFQ. Quotes are due by July 19, 2024 at 4:00 pm Atlantic Standard Time. Award will be made to the lowest priced quote that meets all technical requirements and evaluation factors.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN

COMPETITION IS BASED ON: BRAND NAME SPECIFICATIONS

The 248th Army Band is requesting specific brands, makes and models of musical instruments and components to replace property book equipment that is no longer operational and beyond the documented life cycle. Cases, components, and peripherals selected are to ensure compatibility with existing inventories and replaced items. It is imperative these instruments be replaced by the same brand, make and model to meet consistent mission training expectations and outcomes.

In accordance with DA PAM 220-90 paragraph 6- -quality musical instruments are required for use in Army Music Performance Units (MPUs). Contracting offices will procure musical instruments and related supplies and accessories based on the recommendation of the MPU Commander, Army Music Officer, Warrant Officer Band Master, or the MPU Senior Sergeant (see AR 220-

The 248th Army Band Warrant Officer Band Master recommends, based on professional knowledge and expertise, the specified brand name professional-quality-musical instruments.

Although lesser quality instruments are somewhat playable and may perform the basic functions attributed to musical instruments, these lesser models or other brands are of an untested quality and in some cases, basic student /entry level instruments. These instruments are usually made from lower quality materials, have larger tolerances between movable parts, and commonly require maintenance prior to performance.

Like of instruments of lesser professional quality instruments or varying brands will not meet the performance requirements due to different manufacturing processes, quality of materials and industry performance track record over time. Army Music Performance Units require instruments of professional quality to withstand the rigors associated with the performance of Army Bands. Failure to procure instruments of specified brand and quality may incur an additional risk to the Government in terms of increased replacement rate due to lower life cycle duration and endurance, and deviations could result in additional budgetary costs due to a higher replacement rate.

As previously stated, due to the specific nature of Army Music Performance Units and concurrent with professional performing civilian enterprises, if one musician cannot perform his or her job as a result of being provided a lesser quality equipment, then the mission capabilities of the whole ensemble will be limited, and the quality of the musical support will suffer.
