About this file

This document is a Limited Sources Justification under FAR 8.405-6 for a firm-fixed-price task order to provide six web-based training courses from the Pennsylvania State University (Penn State) to support the General Services Administration (GSA) Public Buildings Service (PBS) Regions 1, 2, 5, and 6.

The total estimated value of the task order is $343,670.40 and the period of performance is from October 3, 2023 to April 21, 2023. The courses cover topics such as effective facility operations and maintenance, facility infrastructure fundamentals, water conservation, facility commissioning, high-performance buildings, and smart building operations. The Justification states that Penn State is the only vendor capable of providing the required courses, which are proprietary and directly meet the agency's Federal Building Personnel Training Act (FBPTA) requirements. Market research was conducted but no other vendors were found that could satisfy the agency's needs. The Contracting Officer has determined that Penn State's proposed pricing is fair and reasonable.

4. The authority and supporting rationale (see FAR Part 8.405-6(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

● FAR 8.405-6(a) Justifications for Limiting Sources (for brand name requirements, please see the following table) (A signed copy of this justification document will be posted to SAM.gov for 30 days within 14 days from the date of award).

● FAR 8.405-6(a)(1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. Provide rationale for your selection:

The basis for other than full and open competition is that these specific courses provided by the Pennsylvania State University (Penn State), are required for certification and there are no other classes similar to these that can be utilized for the certification in support of GSA Federal Building Personnel Training Act (FBPTA) requirements for facility and property managers. The FPBTA of 2010 requires all federal personnel providing building operations and maintenance services to demonstrate competencies necessary to effectively operate government facilities.

Penn State has worked closely with GSA on training that meets the requirements of this Act and these courses will teach managers the ins and outs of how to use the data from their building systems and better understand the tools and terminology needed to effectively communicate with peers while moving ahead in a highly technical workforce.

5. A determination by the ordering activity that the order represents the best value consistent with FAR 8.404(d).

The Contracting Officer (CO) reviewed the submitted quote, conducted market research on the GSA eLibrary, compared the proposed prices with historical pricing and other published price lists and determined that Penn State's proposed price is determined fair and reasonable.

6. A description of the market research conducted among schedule holders, and the results of the research, or a statement why market research was not conducted.

Market research was conducted under the Multiple Award Schedule (MAS), 541690E, Facilities Services category for any vendor that could conduct the requested course or equivalent to the requested requirements. In reviewing the 177 contractors under this category, only Penn State fulfilled the specified training requirements needed.

Additionally, prior history and data determined that Penn State would be the only vendor to respond to solicitation with limited sources justification, due to their proprietary ownership of the specified training courses.

7. Any other facts supporting the limited sources justification.

Not Applicable.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies or services is made.

Penn state courses are proprietary and directly meet GSA needs. However, when this requirement is procured market research will be conducted to determine if other vendor training offerings satisfy the Agency’s requirements.

9. Official Certification & Signatures/Concurrence:

a. Program/Technical Official Certification:

I hereby certify and accept the responsibility that all supporting data provided above or used to justify the above requested for a sole source procurement (e.g., verifying the Government’s minimum needs, schedule requirements, and/or other rationale for other than full and open competition) is accurate and complete to the best of my personal knowledge and belief.
