About this file

This is a Justification for Single Source Award document submitted by the Department of Veterans Affairs (VA) for a brand-name, firm-fixed-price procurement of Zoll Defibrillator CaseReview software licenses and support for VA Palo Alto Health Care System (VAPAHCS), located in Palo Alto, California. The acquisition falls over the micro-purchase threshold but not exceeding the simplified acquisition threshold, with Acquisition ID 36C261-26-AP-3142.

The CaseReview software will provide integrated post-event review and data analytics capabilities for existing Zoll R-Series and X-Series defibrillators purchased in 2020, enabling clinicians to review and improve code response and resuscitation performance. The justification for single source award centers on the unique technical requirements: only Zoll CaseReview software can fully interface with, retrieve, and analyze event data from the installed Zoll defibrillators using proprietary Zoll algorithms, data formats, and communication protocols that are not disclosed to or replicated by competing vendors. The VA's market research confirmed that the required software is unavailable through mandatory or enterprise-wide vehicles, and a search of the Small Business Administration's Dynamic Small Business Search database identified only one authorized Service Disabled Veteran Owned Small Business (SDVOSB) distributor for this brand-name requirement, meaning the VA Rule of Two is not satisfied. The Contracting Officer has certified the purchase as approved in accordance with RFO FAR 12.102(a) and 12.204, with fair and reasonable pricing documentation maintained in the contract file.

Amount: The proposed action is a brand-name, unrestricted, firm-fixed-price open-market order to procure Zoll Defibrillator CaseReview software licenses and support for the VA Palo Alto Health Care System. The software will provide integrated post-event review and data analytics for Zoll R-Series and X-Series defibrillators purchased in 2020, enabling clinicians to review and improve code response and resuscitation performance.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The brand-name justification is that only Zoll CaseReview software can fully interface with, retrieve, and analyze event data from the existing Zoll R-Series and X-Series defibrillators already in use at VAPAHCS. CaseReview uses proprietary Zoll algorithms, data formats, and communication protocols that are not disclosed to or replicated by other vendors, so third-party software cannot reliably capture, interpret, or display the complete defibrillator event data set needed for clinical review and quality improvement. Use of any non-Zoll solution would risk loss of data fidelity, lack of integration with the existing Zoll ecosystem, potential incompatibility with current hardware and workflows, and would require duplicative validation, training, and configuration costs that do not represent best value to the Government. For these reasons, no other supplies or services can meet the Government’s requirement for seamless, end-to-end integration with the installed base of Zoll defibrillators.

4. Description of market research conducted and results or statement why it was not conducted: Market research included review of mandatory and other sources confirmed that the required Zoll CaseReview software is not available from mandatory or enterprise-wide vehicles. A search of the Small Business Administration’s (SBA) Dynamic Small Business Search (DSBS) database, yielded one authorized Service Disable Veteran Owned Small Business (SDVOSB) distributor for this specific brand-name requirement, so the VA Rule of Two is not satisfied.

5. Contracting Officer's Certification: Purchase is approved in accordance with RFO FAR 12.102(a) and 12.204. I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. The determination of fair and reasonable pricing is documented in the contract file in accordance with RFO FAR 12.204(a).
