DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C242-21-AP-1808
1. Contracting Activity:
Department of Veterans Affairs, VISN 2, 528A6, Bath VA Medical Center Center.
2237# : 528-21-3-6085-0097 & 528-21-3-6085-0101
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
The Bath VAMC and Rochester Community Based Outpatient Clinic (CBOC) requires the purchase of 1 each Vyntus One-PFT complete system to ensure the continuous care of our veteran patients, at the highest level achievable.
The estimated value of the proposed action is
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
This request is for two Vyntus One PFT system, initial medical gases, backup breathing circuit, calibration syringe, 3 days of on-site training and sentry connect license. This specific make and model is being requested to standardize our equipment throughout the VA Finger Lake Healthcare System. Currently this specific model is in place at our partner location Buffalo VAMC. Buffalo VAMC reads our PFT’s and this specific setup is needed to avoid errors when transferring patient test results in the Sentry Suite program. This specific product is needed to be compatible with current equipment. Utilizing another brand name, could create incompatibility issues and cross data loss, creating the heightened chance of patient misdiagnosis.
4. Description of market research conducted and results or statement why it was not conducted:
Due to the current PFT equipment being from CareFusion, compatibility is a must. CareFusion equipment is used at our other sites and standardized equipment is needed for staff that may need to go in between the different sites, to ensure they are well versed in the operations of these devices. Staff not familiar with the devices throughout the Finger Lakes Healthcare System, could potentially create safety issues for those patients we treat. CareFusion Vyntus One PFT equipment is the only system that is compatible with our current equipment. The use of any other manufacturer could create safety implications for our patients.

The Contracting Officer had conducted market research to determine possible sources for the equipment being requested utilizing various sources and found the following: A review for available sources for Vyntus One was conducted through the NAC, and found one potential source. Vendor Information Pages (VIP) was queried in search for possible SDVOSB/VOSB's using NAICS 339112 and keywords "Vyntus One" returned 61 possible sources. A search in the SBA-DSBS website using the same NAICS and keyword yielded zero potential source. The DLA ECAT portal was also utilized in doing a market research using the keyword “Vyntus one” and the query returned zero results. The GSA Advantage website was also queried and found 24 potential sources for items under 65 II A SIN A-57.The Federal Procurement Database System (FPDS) was also queried using the keyword “Vyntus One”, in which returned 11 procurement history for the Department of Veterans Affairs. These results were reviewed and indicated that a few of these requirements were competed and some were not competed, and only 4 vendors had supplied the same equipment to the Department of Veterans Affairs Baxter for the past two years. On July 21, 2021 an Intent to Sole Source notice (36C24221Q1062) was posted on Contract Opportunities in SAM.gov with a closing date of 07/29/2021. After the closing date/time, two responses were received from TrillaMed, LLC., an SDVOSB vendor, and from CareFusion 211, Inc.(Vyaire Medical Inc.), a large business, expressing their interest in supplying the equipment being requested.
