Limited Sources Justification Addendum FAR 8.405-6(a)(1)(i)(C)
Date: Apr 28, 2022
Project Title: Aviation and Aerospace Flight and Engineering Support (AAFES) to Personnel
Recovery Forces Award PIID: 47QFSA22F0046 Authority: Mutual Agreement of the Parties, FAR 52.212-4(c) Changes, FAR 52.217-9, Option to Extend the Term of the Contract Order Type: Bridge Effort Vehicle: GSA Multiple Award Schedule (MAS) Engineering Services Category
Background Information
The Limited Sources Justification (LSJ) is being amended to add clause FAR 52.217-9, Option to Extend the Term of the Contract and incorporate option periods as detailed below. The original LSJ did not include FAR 52.217-9 as a result of an agreement of the parties involved to only award a sole-source bridge order for a period of performance (PoP) of four (4) months.
The purpose of the original LSJ was to execute a bridge order to allow for continued contractor support while the competitive acquisition was underway. The initial request from the client for the competitive acquisition was a period of performance of two (2) years plus the six (6) month option to extend services valued at . Due to the low dollar value, the GSA acquisition team felt confident an award could be made within four (4) months in the Spring of 2022. Shortly after the Contracting Officer awarded the four (4) month sole-source bridge effort to Gauss Management Research and Engineering, Inc. on January 28, 2022, the US Air Force, Air Combat Command (ACC) 15th Air Force, 355th Wing, 563d Rescue Group (RQG), referred herein as the Client, informed GSA of the need for a long-term capability for the Air Force to provide AAFES to Personnel Recovery services. The client need is for avionics support services that satisfies the requirements of the ACC and the HH-60G/W Rescue Squadrons Strategies for five (5) years plus six (6) month option to extend services. Due to the additional PoP, the IGE for the follow-on effort increased from to . The GSA acquisition team reviewed the milestone schedule to assess the schedule impacts and also determine the additional internal reviews that would be necessary. The team determined the original milestone plan to award within four (4) months would not be sufficient to successfully solicit, evaluate and award the revised PoP valued at . As a result, the LSJ for the sole source bridge is being amended to allow for the additional time necessary to award the competitive acquisition.
Scope Determination
In accordance with Operational Notice (ON) 2020-007, the CO should make a scope determination with all non-administrative changes. Additionally, COs need to determine if the change is - -
Limited Source Justification Amendment 01 47QFSA22F0046 P00002 Page 2 of 5
In making the determination, the CO should consider the following:
Type of work to be performed under the modification compared to the work performed under the originally awarded/current contract/task order;
The type of work to be performed and taskings assigned under this task order fall within the same technical requirements of the base period and remain unchanged. This modification does not deviate from the originally awarded task order scope and is merely a change to the PoP and a continuation of the technical requirements the established services to provide for aircraft avionics support specific to each of the HH-60G/W Squadrons. Avionics support specialists shall reside in the Squadron or Group Tactics shop and shall analyze, develop, and recommend solutions to reliability and maintainability problems. In addition, they provide support to Operations and Weapons and Tactics personnel, System compatibility with Operations Centers and mission planning systems. Perform as the single point of contact in-garrison and deployed to provide system support and training for aircraft capabilities integrated as part of current and future permanent and temporary modifications. Additionally, avionics system specialists shall be responsible for maintaining crypto requirements for aircraft avionics to include ensuring crypto loading devices are up to date and available for aircrew prior to flight or mission execution throughout the option periods.
The amount of effort required to perform the work under the modification compared to the amount of effort required to perform the originally awarded/current contract/task order;
The proposed modification to add option periods to the short-term bridge task order would ensure continuation of services while the competitive acquisition is underway. The requiring activit minimum needs and required levels of service can only be satisfied by the incumbent contractor until a follow-on task order is awarded. The amount of effort required by the contractor to perform the work added by this modification is exactly the same and is utilizing the same skill levels and distribution of personnel across the three (3) squadrons. The difference is that the work is continuing for a longer period of time, with no change to the day-to-day support requirements. The amount of effort to establish a new task order or award the follow-on acquisition within the time remaining in the base period, would result in a break in service. Without modifying this bridge order, the schedule risk increases significantly as there is very little possibility a follow-on task order will be awarded by the end date of the current bridge order. Adding the three (3) option periods to this short-term bridge order is the quickest and most cost-effective way to avoid a lapse in coverage and maintain full operational performance of the required services, avoid loss of skilled contractor staff, and allow GSA the time to make the follow-on award and allow for the phase-in period.
Changes in time of performance; and
The bridge base period of performance of 2/3/2022 through 6/2/2022 will remain;
however, option periods will be added as follows
Limited Source Justification Amendment 01 47QFSA22F0046 P00002 Page 3 of 5 o Option Period 1: June 3, 2022 August 2, 2022 o Option Period 2: August 3, 2022 September 2, 2022 o Option Period 3: September 3, 2022 October 2, 2022
The three (3) option periods will increase the estimated total price of the bridge by from to . Adding the aforementioned option periods will allow the acquisition team the necessary time to award the follow-requirement based on a PoP of five (5) years and six (6) months while also ensuring the successful offeror is afforded a one (1) month transition period.
Scope of the original competition and whether offerors that proposed on the existing contract/task order could have reasonably contemplated the proposed modification (i.e.
competitive interest and response to the solicitation would have been impacted).
The scope of work to be performed under this task order remains unchanged from the original competition. The addition of options periods for this bridge effort would not change or impact the competitive interests from the original competition. Considering the base performance period of four (4) months for the b modification for the additional PoP does not offer an increased efficiency to be gained in a competitive award nor does it offer a cost savings of further discounted rates. Because the original incumbent order did include the Options and the -8 Extension of Services clause, it is reasonably contemplated that all vendors associated with the incumbent acquisition could have reasonably contemplated the proposed modification. The current awardee, GMRE, being aware of the staffing challenges and the short timeline, could also have led them to reasonably contemplate the modification to extend support for continuity of services.
Conclusion:
The client is requesting to add FAR 52.217-9 Option to Extend the Term of the Contract to the bridge order 47QFSA22F0046 to allow time to complete a full phase-in migration to the competitively awarded follow-on effort without loss of critical ACC Rescue Group operational support. As such, this LSJ is amended to incorporate three (3) option periods for a total of four
(4) additional months, if all options are exercised, and increase the estimated value covered by FAR 52.217-9. The Contracting Officer has also determined addition of the option periods are within scope of the bridge effort.
