LIMITED SOURCES DOCUMENTATION (MAR 2021)

Required for Limited Source Acquisitions Over $10,000 but not Exceeding $250,000

Acquisitions that do not allow for competition to the maximum extent practicable must be documented in accordance with Federal Acquisition Regulations (FAR) 13.106-3(b) for open market purchase orders or FAR 8.405-6(b)(2) for Federal Supply Schedule (GSA) orders. Limited source documentation is required in the following circumstances: (1) when soliciting fewer than the minimum number of sources (at least three sources) required by FAR 13.104(b), 8.405-1(c), or 8.405-2(c)(2), whichever is applicable; and (2) when using brand name only specifications.

This template may be used for the documentation described in FAR 8.405-6(b)(2)(i) or 13.106-1(b)(1). The customer shall provide the following information:

Brief description of supplies or services required and the intended use:

The U.S. Department of Justice, Drug Enforcement Administration (DEA) Aviation Division (SG) has a requirement for aircraft foreign liability insurance coverage for it foreign operated aircraft. This liability coverage is required by all foreign governments for any aircraft operating within or passing through their territorial boundaries.

Unique characteristics that limit availability to only one source, and any justification that no other supplies or services can be used or that urgent and compelling circumstances exist – include all critical delivery or performance dates and impact to the government if dates are not met:

The DEA Avaition Division requires specific liability insurance for government-owned aircraft that operate in foreign countries. The DEA Aviation Division requires an insurance provider who shall:

• Provide a master policy for blind coverage for SE aircraft.

• Allow SG to complete their own insurance certificates for each mission.

• Allow SG retain the insurance files for security reasons, (no records of any SG aircraft are kept at the insurance carrier's office). This flexibility allows the pilots to operate SG aircraft with complete confidence that vital information is kept confidential and within the confines of the SG.

• Waving insurance requirements, such as:

o Destination of the aircraft.

o Purpose of the trip.

o Pilots names and aircraft ratings.

o Aircraft's home station.

o Aircraft make, model and registration.

Describe in detail any market research conducted. Include results and state whether any vendors expressed interest:

For the past several years, SG personnel have conducted market research to find an aviation insurance provider that will provide aircraft liability insurance with the flexibility required by SG's unique mission requirements. Only CS&A Aviation Insurance is the only known insurance provider that can accommodate SG's requirements. This market research consists of talking to industry representatives and attending trade shows such as the National Business Aircraft Association, and previous procurement history.
