About this file

This document is a sole source justification for the procurement of two OMAX Tilt-A-Jet retrofit kits and associated freight costs totaling $85,600 by the Army Contracting Command - Detroit Arsenal from Phillips Corporation, Federal Division. The retrofit kits will allow the integration of precision, taper-free machining capabilities into OMAX machinery utilized by the U.S. Army Combat Capabilities Development Command Ground Vehicle Systems Center Prototype Integration Facility. Market research confirmed Phillips as the sole authorized distributor and service provider for OMAX equipment for U.S. Federal Government accounts, as they have an exclusive distribution agreement in place and non-approved vendors would void the manufacturer warranty. Similar justifications have been executed by the U.S. Air Force, Navy, and NASA for these products, also citing their sole-source nature. The associated solicitation is for the referenced retrofit kits under number W56HZV-23-Q-L045.

Department of the Army Sole Source Justification for Purchases under the SAT

(Using FAR Part 13)

Purchase Request #: 11988518

1. Contracting Activity: The Army Contracting Command – Detroit Arsenal (ACC-DTA), MI is the procuring activity for this action.

2. Description of the Supply or Service Purchased:

The U.S. Army will purchase two (2) OMAX Tilt-A-Jet retrofit kits (OMAX part # 303390-13) for $42,500.00 each, totaling to $85,000.00. The U.S. Army will also pay freight costs of $600.00, for a grand total of $85,600.00.

3. Dollar Amount: The total estimated purchase price is $85,600. The type of funds is FY22-

23 RDT&E.

4. Authority Cited: The authority that permits the soliciting of one source for this procurement is FAR 13.106-1(b)(1), which permits the contracting officer to solicit from one source upon determining that only one source is reasonably available based on the circumstances of the procurement.

5. Reason for Authority Cited

OMAX is the original equipment manufacturer (OEM) for the Tilt-A-Jet and the associated retrofit kits that the allow the Tilt-A-Jet to be fitted to any OMAX machinery. The U.S. Army Combat Capabilities Development Command Ground Vehicle Systems Center (DEVCOM GVSC) utilizes OMAX machinery in the Detroit Arsenal Prototype Integration Facility (PIF) which will integrate the retrofit kit to enable precise, taper-free machining. The Phillips Corporation, Federal Division (Phillips), is OMAX’s sole authorized distributor and service provider for U.S. Federal Government accounts.

6. Market Research:

Market research revealed that while the Tilt-A-Jet is commercially available from a number of distributors online, Phillips is the sole-source distributor for all OMAX OEM machinery and parts for the U.S. Federal Government. While inquiring with industry partners and potential distributors, OMAX Corporation furnished a letter to DEVCOM GVSC stating the exclusive nature of their relationship with Phillips as the sole distributor for their Government accounts for all parts and services with full warranty by OMAX, with non-approved vendors and aftermarket parts voiding the warranty.

Further investigation of similar requirements solicited through SAM.gov by the U.S. Air Force, U.S. Navy, and the National Aeronautics and Space Administration (NASA) corroborate the sole-source nature of this procurement, varyingly citing their efforts as either sole-source or brand name requirements.
