About this file
This brand name justification document outlines a requirement by the Office of Personnel Management's Office of Inspector General for data warehouse licenses. The agency requires a suite of licenses compatible with its migrated on-premises data center to support technical architecture services and road mapping for the current and future state of its data warehouse and data marts. The one-year performance period is valued at an estimated amount above the simplified acquisition threshold. Market research found no alternative acquisition sources that could meet the requirement without significant risk, cost, or transition delays. To promote competition, the agency will compete the order as a small business set-aside, with the justification notice to be posted on SAM along with the limited source solicitation.

Office of Inspector General (OIG) Data Warehouse Licenses Requirement
Justification for Other than Full and Open Competition
1. Contracting activity:
This Brand Name Justification is generated by the Office of Personnel Management’s (OPM), Office of
Inspector General (OIG).
2. Action being approved:
The U.S. Office of Personnel Management (OPM) Office of Inspector General (OIG) is in the process of modernizing its SAS legacy Data Warehouse. OIG is currently receiving support to provide technical architecture services and a road map for both the current and future state of the OIG Data Warehouse and
Data Marts. The contractor is providing Business Intelligence System Architecture, Data Architecture and
Data Modelling services, as well as security access controls architecture for safe guarding the data and for providing role based data access. In order to provide this support, the contractor requires a suite of licenses as noted within the Bill of Material (BOM) that can be found within the contract file.
3. Supplies or services required to meet the agency's needs:
OPM OIG requires licenses as noted within the BOM. The period of performance will be for one year from date of award. The total estimated value of the requirement $X.
4. Statutory authority permitting other than full and open competition:
This sole source acquisition is made pursuant to the authority of FAR 13.106-1(b)(2), Soliciting from a
Single Source for purchases exceeding the simplified acquisition threshold, utilizing the procedures in
FAR 13.5 in accordance with 41 U.S.C. 1901.
5. Demonstration that the contractor's unique qualifications or the nature of the acquisition requires the use of the authority cited:
OPM OIG on-premises Data Center has been migrated to <REDACTED> within <REDACTED> for improved efficiency, agility, innovation, and sustainability. Two main drivers of that migration were the increasing benefits and mandates for cloud migration and Data Center consolidation. <REDACTED>.
The secured environment has successfully undergone the Authority to Operate (ATO). The licenses within the BOM for this requirement are compatible with the environment and no other licenses can be used at this time.
<SECTION REDACTED>
The Data Center system is reliant upon compatible products and services in order to continue to operate and function properly and efficiently. Hardware and software maintenance purchased must meet or exceed technical requirements as stated by the OPM Office of the Chief Information Officer (OCIO).
Meeting these requirements is necessary in order to ensure a seamless integration. Each item within the
BOM has been vetted to ensure IT standards are met or exceeded and will seamlessly integrate within the architecture. The licenses contribute to the transformation of complex data and information as well as the processing and reporting of said data and information for OPM OIG users. Any equipment that does not seamlessly integrate with the computing environment will leave the Data Center vulnerable, potentially resulting in considerable downtime and loss of productivity for OIG users as well as jeopardizing the day-to-day operation of OPM OIG.
There are at this time no other feasible acquisition alternatives that would not represent a significant risk to OPM OIG and its data, incurring additional costs through the duplication of already established equipment and extensive transition support necessary in an attempt to reduce the aforementioned risk of damaged and lost data. To do this with the current staff would take years to evaluate and certify new tools for every capability and extensive man-hour costs to test and integrate into OPM IT environment which would result in unacceptable delays. This approach introduces a level of risk to the agency and its established network that could not otherwise be immediately mitigated.
6. Efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:
A Combined Synopsis and Solicitation will be publicized along with this Justification on beta.sam.
7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable:
Based on a current assessment of the market research conducted, the Independent Government Cost
Estimate (IGCE) provided, and the published price lists available for this requirement, the
Contracting Officer has determined that the anticipated cost to the Government will be fair and reasonable.
8. Description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted:
The Government reviewed the procurement and services list maintained by the Committee for Purchase from People Who are Blind and Severely Disabled as well as supplies manufactured and services performed by the Federal Prison Industries, Inc. The priorities for sources of supply as outlined in FAR
Part 8 were considered. Potential sources such as agency inventories and excess from other agencies were eliminated from consideration as the requirements are extensive including multiple brand name requirements.
Market research has demonstrated that the required service is of a type offered and sold competitively in substantial quantities in the commercial marketplace. The Government first utilized the Market Research
Tool on NASA SEWP. Searches utilizing key word(s) ‘IBM’, ‘Tidal’ ‘Toad’ only yielded one vendor:
Sterling Computers. The hit was only for IBM. Given the lack of vendors that could potentially supply the needed suite of licenses, NASA SEWP was determined not to be an appropriate vehicle to satisfy the
Government need.
The Government then searched the GSA Schedule utilizing the instance types within the BOM. GSA provided numerous vendors that were able to provide some of the tools found within the BOM; however, no vendor was able to supply all the licenses that are found within the BOM. In order to be able to order off of GSA, a vendor would need all the items under their GSA Schedule contract. As no vendor has the entire suite of items on their GSA Schedule and a modification to a vendor’s GSA Schedule can take up to 6 months or more to complete. This timeframe to complete a modification is beyond the timeframe in which the Government needs the award. As such, a determination was made that GSA was not an appropriate vehicle to satisfy the Government need.
To ensure the Government receives robust competition, a determination was made to compete the requirement on the open market as a small business set-aside. Market research has found multiple small business vendors that would be able to quote and satisfy the requirement.
9. Other facts supporting the use of Other Than Full and Open Competition:
None.
10. Sources that expressed, in writing, an interest in the acquisition:
None.
11. Actions the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
The Government will continually utilize market research techniques to ensure the suite of licenses are the best fit for the Data Center and if any other tools can be utilized that may be in the best interest of the
Government.
In accordance with FAR 13.501(a)(iv), a redacted copy of this justification shall be posted with the solicitation to beta.SAM.
