Notice of Intent 04/7/2021

RE: SOLICITATION #1240BJ21Q0024

This is not a request for Quote – This is a notice of the government’s intent to issue a sole source award to DIVCO, Inc., under the authority of FAR Part 13.106-1 (b) (1), only one responsible source is available and no other services will satisfy the agency’s requirements.

This is a sole source justification for the SO Building 2002 HVAC Pressure Reduction Forest Headquarters, Colville National Forest. This is a justification for other than full and open competition for a natural follow-on contract to update a design previously completed by the contractor.

This project is unique and requires a specific contractor to ensure that provided equipment and controls will be compatible with the existing HVAC system and controls. The existing system that will need to be modified to add the additional equipment has proprietary software of which the Contractor, DIVCO, Inc., is the only authorized service provider in the area.

The software used on the HVAC system is a Schneider Electric software and they only allows DIVCO to be the vendor within this area. Since the additional equipment must be integrated into the system there would be a higher cost for a different vendor to turnaround and sub the project back to DIVCO. The computer used for the system is a DIVCO owned computer.

The contractor is very familiar with the building and this project as they frequently service this system. Updating the existing system would be much more time intensive and costly to the Government with another contractor who has no familiarity with the existing design.

This Notice of Intent is not a request for competitive quotations, however, interested parties may identify their interests and capability to respond to this requirement by April 14, 2021, 12:00 PM, PST to the Point of Contact listed below. A determination by the Government not to compete the contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
