About this file
The document is a Request for Quotation (RFQ) issued by the New York State Office of Parks, Recreation and Historic Preservation (NYSOPRHP) for the Letchworth Stiltgrass Treatment project at Letchworth State Park. The project involves herbicide treatment of Japanese Stiltgrass (Microstegium vimineum) across approximately 4 acres of wooded terrestrial trails within a 10-acre project area, located between the Big Bend Trailhead (#10) and Trillium Trailhead (#10A). The pre-bid site meeting is scheduled for June 18th, 2025 at 11:00 AM, and contractors will be required to use a foliar spray method to apply herbicide, with continuous monthly surveys and spot treatments throughout the growing season (July through October) from 2025 to 2027. Only NYSDEC-certified applicators may perform the treatments, and they must follow specific environmental protection guidelines.
The RFQ indicates this is a unit price sum contract with a lump sum cost covering all permits, materials, equipment, transportation, personal protective equipment, and incidental costs. The project is not a prevailing wage contract, and bidders must submit documentation of their qualifications, including at least three comparable projects and herbicide product labels. Contractors must provide comprehensive insurance, including commercial general liability and comprehensive business automobile liability insurance. Additional certifications required include compliance with NYS Finance Law, Executive Orders regarding business operations, and Public Officers Law. The solicitation encourages good faith efforts to include Minority and Women-Owned Business Enterprises (MWBE) and Service-Disabled Veteran-Owned Businesses (SDVOB), though specific goals are not mandated for this procurement.

Detailed Specifications
Control Methods: All pesticide applications in this project will comply with the applicable rules and regulations for the proposed pesticide product. To minimize potential impacts, herbicides will be used judiciously and applied with the most precise techniques available.
Only NYSDEC-certified applicators will perform the treatments, following best management practices and using appropriate personal protective equipment (PPE) as specified by the pesticide label. Applications will take place under low-wind conditions to prevent drift and overspray. The required waiting period between application and rainfall will be based on the specific instructions on each herbicide label. Furthermore, herbicide mixing, and storage will occur at least 300 feet away from any water body. These measures are designed to minimize potential effects on water resources, natural habitats, and non-target species. Control methods will include foliar spraying of the targeted species.
Foliar Spray Method: The contractor will supply and apply herbicide directly to the leaves of the target species using a foliar spray. The herbicide will be applied at an approved diluted concentration, mixed appropriately, and applied to the leaves with a spraying device.
Specific Treatment Approach: The control methods are utilized in one category of treatment: Stiltgrass Treatment Approach. The method is described in detail below. The Contractor is directed to use the Stiltgrass Treatment Approach as the primary means of control at each treatment location.
Stiltgrass Treatment Approach: The contractor shall treat Japanese Stiltgrass using herbicide. Use a foliar spray method with herbicide application for all Stiltgrass populations. Contractor shall continuously survey areas surrounding infestation for any new or missed growth monthly throughout the growing season (July through October) before the plant begins seeding and spot treat as needed.
Treatment in 2025-2027: First round of treatments will be completed between July and October (before the plant begins seeding) and should continue yearly during this same timeline through 2027 for all locations. Contractor shall continuously survey areas surrounding infestation monthly for any new or missed growth throughout the growing season and spot treat as needed.
Documentation and Communications: The contractor shall submit all necessary permits for herbicide application related to this project. The contractor will be responsible for paying the permit application fee to the DEC. Additionally, the contractor shall complete the required DEC forms to document herbicide applications and submit the completed forms to NYSOPRHP in both hardcopy and electronic (PDF) formats within three weeks of treatment. The contractor is also required to provide representative digital photographs (.jpg format), including before-and-after photos of each treatment area, action shots (such as spraying or mixing), and general location photos (e.g., panoramic views). A list of photo numbers, captions, and acquisition dates must accompany the photos. Before beginning any work, the contractor must inform NYSOPRHP of the planned schedule. While weather conditions and other factors may necessitate schedule adjustments, the contractor must notify NYSOPRHP of any changes at least one week in advance. The contractor must also coordinate with the project manager to ensure the scheduling of this work aligns with any other ongoing projects in the park.
Access and Safety: Access to the project sites is available by car/truck or approved equipment. All vehicles and equipment must display the contractor's name visibly. The treatment areas can be reached through the Parade Grounds entrance on the east side of Letchworth State Park, continuing along the main road to the Trailhead for Trail 10.
Offshoots from the main trail can be accessed by ATV, UTV, side-by-side vehicles, or on foot. Any disturbed or damaged lawn areas must be repaired by the contractor. Parking will be available during daylight hours, and no equipment should be left overnight. Contractors are required to provide appropriate traffic and pedestrian safety measures for any road or trail obstructions, following the guidelines outlined in the Manual on Uniform Traffic Control Devices (MUTCD). A site safety plan must be submitted by the contractor, and high-visibility clothing must be worn while working on park property. Additionally, the contractor must provide the project manager with all emergency contact information.
Applicator certification, herbicide selection and handling: The contractor is responsible for complying with all federal, state, and local regulations related to the purchase, transport, application, and disposal of herbicides. The contractor must be a certified applicator through the DEC. New York State regulations mandate that herbicide concentrations must adhere to the manufacturer's specifications on the product label.
These mixing instructions should not be altered unless the manufacturer issues supplemental labeling materials that are approved by the State.
Miscellaneous Requirements: All treatment locations are situated on public lands.
Bidders should anticipate potential restrictions on mechanical cutting in one or more treatment areas. Work is not permitted on weekends, holidays, or during periods of high use. If the contractor wishes to work on a weekend or holiday, approval must be obtained from the project manager at least one week in advance.
Protection of the Site: The contractor is responsible for protecting existing native vegetation, equipment, structures, utilities, and other improvements at the project site and on adjacent properties, except for those designated to be removed or altered. Upon completion of each treatment event, the contractor must clean and restore each work site and access roads to their original condition, repairing any damage to existing facilities, such as trails, roads, and parking areas, to their original or better condition.
Environmental Protection: The contractor is responsible for implementing measures to protect the environment, operate temporary facilities, and carry out construction activities in compliance with environmental regulations, minimizing the potential for air, water, soil contamination, or other harmful impacts. The contractor must ensure that all personnel adhere to applicable environmental regulations, including federal, state, and local laws related to pollution control and the protection of plants and wildlife.
Precautions must be taken to prevent damage to nearby vegetation from wind drift or handling herbicides, fuel, or other hazardous materials. The contractor must also comply with permit conditions, including applying herbicide only during low wind conditions and avoiding application during or immediately before rain. forecasted rain.

The Human Rights Law may also require reasonable accommodation for persons with disabilities and pregnancy-related conditions. A reasonable accommodation is an adjustment to a job or work environment that enables a person with a disability to perform the essential functions of a job in a reasonable manner. The Human Rights Law may also require reasonable accommodation in employment on the basis of Sabbath observance or religious practices.
Generally, the Human Rights Law applies to:
all employers of four or more people, employment agencies, labor organizations and apprenticeship training programs in all instances of discrimination or harassment;
